Responsibilities of Jurors • Beyond a Reasonable Doubt: in a criminal case, a person charged with an offense against the law is found guilty if there is no hesitation by the jurors. • Preponderance of Evidence: in a civil case, a person charged with an offense against the law is found guilty if there is no hesitation by the jurors.
Innocent until proven guilty • Defendant is presumed innocent of the charge(s). The defendant is innocent during the entire case. Defendant “allegedly” committed the crime. Must be found not guilty unless the state proves guilty beyond a reasonable doubt.
Reasonable Doubt • Decisions must be based on evidence presented during the trial. Jurors cannot go outside the evidence and guess what may have happened and/or investigate on their own.
Definition of Reasonable Doubt 95% • The law does not require proof that overcomes every possible doubt. If a jury is firmly convinced the defendant is guilty of the crime, must vote guilty. If there is a possibility the defendant is not guilty, must vote not guilty.
Definition of Preponderance of Evidence 51% • The plaintiff in a civil case must prove by evidence that their version of the facts is more likely to occur than the defendant’s version. Leaves room for more doubt than criminal case.
Definition of Clear and Convincing 75% • Standard used in some civil cases. The plaintiff must prove by clear and convincing evidence that his or her facts is much more likely to be true than the defendant’s version. Falls between preponderance of the evidence and beyond a reasonable doubt.
Suspicion • No direct evidence/proof a person committed the crime. In the area but no concrete proof.
