  2. What is a Transfer of Service (TOS) The Transfer of Service Exemption (Wis. Stat. § 121.91(4)(a)3)provides that a school district which assumes responsibility for a program or service from another governmental unit may request and be granted an exemption to the district revenue limit equal to the increased cost due to that program or service. Note:The Transfer of Service Exception provides additional levy authority to cover the increase in Special Education cost for a child with a disability. The Transfer of Service process is not to be used to address Americans with Disabilities Act (ADA) needs for a new student. ADA requirements are a general education responsibility.   3. What is a Transfer of Service (TOS) There are 3 possible areas for a district to make a TOS request: A student with a previously identified disability Wis. Stat. §115.76(5)(a) A student was previously identified as participating in a limited English proficiency program Wis. Stat. §115.955(7) Transfer of financial responsibility between school district and a local municipality, that the municipality previously paid related costs – Narrative TOS - (unusual requests). See Narrative-Transfer-of-Service-May-2017 for more information.

  4. Where to make a TOS Request Each school district will use the PI-5000 TOS online portal to make a TOS request regarding: A student with a previously identified disability Wis. Stat. §115.76(5)(a) A student participating in a limited English proficiency program Wis. Stat. §115.955(7) Within the PI-5000 portal are three Parts to be completed in order to have an adjustment to the district revenue limit for the coming school year.

  5. When to make a TOS Request The PI-5000 TOS online portal is scheduled to… Open on Monday, May 20, 2019. Part A is where the per student request is entered by the district. Closing date is Friday, September 20, 2019 Part B is where another WI district would need to respond if the student came from their district within a 15 month period (June of pervious year through early September of current year). Closing date is Wednesday, September 25, 2019 Part C is where the district’s request is submitted to DPI. Closing date is Friday, October 4, 2019

MJSD Process Create a shared spreadsheet Timeframe: Sept 21st, 2018-Sept 20th, 2019 Track expenses for the school year and the summer Track new students coming into the district from other governmental units with an IEP or LEP need Hold a meeting in late May/early June with key staff who work with IEP or LEP students to evaluate possible TOS requests

  7. MJSD Process Cont. In late June/early July enter each TOS request that can be justified. Keep separate tabs for ELL and Special Education Students Monitor enrollment of students that leave the district over the year and summer. Reevaluate staffing ratios Utilize the decision tree to determine eligibility

  10. What to consider in making a TOS Request (1) A copy of the TOS Decision Tree is available on our “Transfer of Service” https://dpi.wi.gov/sfs/limits/exemptions/transfer-servicewebpage. On the next 3 slides we will go into more detail on how to use the 6 questions on the TOS Decision Tree, sub-divided into 3 Steps.

  11. What to consider in making a TOS Request (2) Step 1. Someone should be collecting the names of students who move into your school district this school year, where the student came from (another governmental unit school), and did they arrive with an identified disability or participating in a limited English proficiency program.

  12. What to consider in making a TOS Request (3) Step 2. In late April the district should review the list of students identified in Step 1 and answer the following questions for each student. Did the student arrival cause the district to incur a cost that was not budgeted for in the current year? Does the district believe this student will return in the fall?

  13. What to consider in making a TOS Request (3) 3. If so, what additional resources will the district need in the coming year (not including the current year cost) to meet the identified needs the student arrived with? In Question #6 the district must now review the district available resources: Resources made available because other students have graduated or relocated Previous TOS request approved If the answer to #6 is NO, the district can now consider making a TOS request for this student.

  14. What to consider in making a TOS Request (4) Step 3. Other factors to consider: Was the student Open Enrolled before coming to your district: • In PI-5000 Part A you will need know where the district student lived, not the district the student attended in the pervious year. A TOS request can only be based on identified disabilities the student arrived with, not any new ones your district’s IEP Team diagnosed. Your district is not expected or required to provide the exact same service process used by the pervious district in all cases. • (Example) pervious district had a large program for students with this disability in school building. No one-on-one aid was assigned per the IEP. • Your district has no other student with that identified disability in your school building this student is attending. Your district’s IEP team determines that this student will need a one-on-one aid to meet the student’s disability. That is acceptable.

  15. Using the Decision Tree on Real World Examples Districts should use the six questions of the Decision Tree when considering a TOS request.

  16. Real World Examples (1a) A new 3rd grade student from a public school district on the other side of WI, identified with Speech / Language enrolls on October 29, 2018. The IEP requires 30 minutes of service 3 times/week. Your district contacts with a 3rd party to provide this service. Lets look at questions 1 – 5 on the TOS Decision Tree. The service provider has notified you that in 2019-2020 this will increase your cost (1.5 hours x 36 weeks x $60/hour = $3,240/year). A TOS request can be submitted if the answer to question 6 is no.

  17. Real World Examples (1b) By mid March 2019 - 8 new elementary students enroll from other public school districts and each was identified with Speech / Language. The IEP requires 30 minutes of service 3 times/week. Your district provides Speech / Language with your own staffing positions. Lets look at questions 1 – 5 on the TOS Decision Tree. The service provide can be provide to each new student by adjusting the staffing assignments between schools, with no new costs for your school district. A TOS request can NOT be submitted, if the answer to question 6 is yes.

  18. Real World Examples (2) 30 new students enroll in different grade levels with limited English skills in March of 2019. They are part of a refuge program supported by multiple community organizations within the district. Lets look at questions 1 – 5 on the TOS Decision Tree. TOS Decision Tree, question 1 is not known. Your district has one staff member who can interpret for these students and is currently working a 90% contract and the district will need to increase to 2 full-time interpreters and additional support materials. The estimated cost will be $45,000 in staff increases and $2,500 for support materials. A TOS request can be submitted if the answer to question 1 is yes. If no, no additional levy authority will be granted.

  19. Real World Examples (3a) A high needs 4th grade student from Ohio enrolls in late January of 2019. This student comes with the IEP calling for a full-time IEP services registered nurse (RN). Lets look at questions 1 – 5 on the TOS Decision Tree. Your district receives standard nursing services from the County at no cost. The estimated cost will be $80,000 for an additional IEP service RN from the County or as a district hire. A TOS request can be submitted, if the answer to question 6 is no.

  20. Real World Examples (3b) A high needs 4th grade student from Ohio enrolls in late January of 2019. This student comes with the IEP calling for a full-time registered nurse (RN). TOS Decision Tree, questions 1 – 5 are answered in the pervious slide. Your district receives standard nursing services from the County at no cost. On March 30, 2019 the County gives the District formal notice that as of July 1, 2019 they will no longer provide any nursing services. The estimated cost will be $160,000 to hire two RN positions. Two TOS request can be submitted. The first request (IEP service RN) was described in 3a (pervious slide) and will be made through the PI-5000 portal. ($80,000) The second request (standard nursing services) would be a Narrative TOS request, submitted in writing, on next slide. ($80,000)

  21. Real World Examples (3c) On March 30, 2019 the County give the District formal notice that as of July 1, 2019 they will no longer provide any nursing services. The estimated cost is $80,000 to hire one RN to provide standard service as of July 1, 2019, previously from the County. A Narrative TOS request must be submitted in writing to Bruce.Anderson@dpi.wi.gov or DPIFIN@dpi.wi.gov. (see slide #3). This request should be made by May 1st, so the district can plan. On the Transfer of Service webpage is a link to “Narrative Transfer of Service” information. Click on the “Instructions for a Narrative Transfer of Service” link follow the directions provided. The SFS Team will review the request and notify the district of the decision.

  22. Real World Examples (4a) A 6th grade student from a public school district on the other side of WI, enrolls in late April of 2019. This student’s IEP placed the student in a 3rd party service location due to severity of disabilities. Lets look at questions 1 – 5 on the TOS Decision Tree. Your district has a program in place for similar students at the middle school level and it is believed that with an additional support positon you can meet the student’s needs. The estimated cost will be $40,000 for an additional position for the 2019-2020 school year. A TOS request can NOT be submitted, if the answer to question 6 is no.

  23. Real World Examples (4b) A 6th grade student from a public school district on the other side of WI, enrolls in late April of 2019. This student’s IEP placed the student in a 3rd party service location due to severity of disabilities. Lets look at questions 1 – 5 on the TOS Decision Tree. Your district has NO program in place for similar students at any school level that can meet the student’s needs. The district’s IEP team quickly decides to have the student continue at the current 3rd party location for the remainder of the year and in 2019-2020 school year. The estimated cost will be $90,000 for tuition and transportation for 2019-2020 school year. A TOS request can be submitted, if the answer to question 6 is no.

  24. Real World Examples (5a) Your district has a 9th grade student, with an IEP. who was Open Enrolled out(full time) as an 8th grader and now returns. Why can’t our district submit a TOS request? This Open Enrolled out student remained enrolled in your district. Your district had agreed to pay another school district for services provided as defined by statute during grade 8. (You will count in PI-1563 Step 4.) On the TOS Decision Tree - see question 1 where the answer is no, your district retained financial responsibility during the 8th grade and now in 9th grade for both educational services and financial responsibility.

  25. Real World Examples (5b) Your district receives TOS request for a 7th grade student, with an IEP, who wants to Open Enrolled in (full time) as an 8th grader in the fall of 2019. Why can’t our district submit a TOS request? This Open Enrolled in student remains enrolled in the district they live in. Your district has agreed to provided the student’s educational services and will be compensated by the resident district, as defined by statute during grade 8. On the TOS Decision Tree - see question 1 where the answer is no, the resident district retained financial responsibility during the 8th grade and your district will be compensated for said educational services.
