NRCS E&T Responsibilities • Endangered Species Act (ESA) 1973 • Section 9 –Prohibits “take” of animals (take is to harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect) • Section 9 – Prohibits removal or damage of plants on federal lands or in violation of state law on other lands.
NRCS E&T Responsibilities State listed species – NRCS regulations at 7 CRF 650.22 require that the NRCS concern for species and habitats will not be limited to those Federally listed or proposed under the ESA, but will include those designated by State and Tribal agencies as rare, endangered, threatened, or species of concern.
Evaluation of E&T Species • Evaluation of Federally listed species • USFWS County List • Habitat for the species in the action area • Presence of the species in the action area • If “No Affect” document and proceed with plan • If “May Affect” send to S/O for consulation • Evaluation of State listed species • EcoCAT inquire, if protected resource found: • Refer to specialist for E&T Review
E&T ReviewBasic Instructions for Field Offices • For every CPA-52 evaluation, go to the EcoCAT site and obtain a report for the planning site. • If nothing is listed for thesite, document it on the CPA-52 under J – Special Environmental Concerns, “E&T Species” and “Natural Areas”. • If there is a resource listed, send a copy of the report and the NRCS E&T Review request to your Area E&T Coordinator.
Endangered Species Act • “May Affect” – Agency determination that does NOT require USFWS concurrence. Includes both negative and positive affects. • “May Affect, but not likely to adversely affect” – Agency determination that requires USFWS concurrence based on a Biological Evaluation.
Programmatic Consultation Forest Stand Improvement and Prescribed Burning practices (for EQIP) effect on the Indiana bat and gray bat. Informal Consultation with USFWS Conservation Measures that will result in decision of may affect but not likely to adversely affect the Indiana and gray bats.
Future Revisions Revised Illinois E&T Review Procedures may include: • Outline evaluation procedure for Federally Listed species. • Conservation Measures for Indiana bat, gray bat, and bald eagle. • Screen out many evaluations on cropland that will have no affect.
