FIDIC MDB Harmonised Construction Contract Conference Session 2: Overview of Key Issues from 2011 The Consulting Engineer’s Perspective Philip Jenkinson – Chair, FIDIC Contracts Committee Principal Consultant, ATKINS
The Engineer • Duties and Authority • Quality of Supervision • Status – who is in charge on the Site? • Design – supervision continuity: good or bad?
Procurement • Standardisation • Shortage of appropriate skills • Misuse of Contracts • Project preparation standards
Administration • Compliance with local/applicable laws • Local Authorities – permits • Land Acquisition • Need for improved awareness
Labour • Construction – a hazardous industry • Rudimentary conditions in many locations • Workers’ should know/be told rights • Enforcement of international standards
Dispute Boards • Favoured and generally successful, BUT • Provisions sometimes deleted • Decisions sometimes unenforceable • More emphasis on dispute avoidance needed
Corruption • Considered to be widespread • Contractors/Employers/Engineers implicated • Transparency of all project processes needed • Parties responsible for avoidance
