Why Local Medical Control Authorities Are Key to Regional Planning Efforts • LMCA’s are existing hospitals or groups of hospitals • LMCA’s already coordinate EMS and ED activities • LMCA’s already work with 911 and other parts of the emergency management system • LMCA’s are recognized in law and can adopt protocols with legal authority
LMCA Protocol Authority Sec. 20919(1). A local medical control authority shall establish written protocols for the practice of life support agencies and licensed emergency medical services personnel within its region. The protocols shall be developed and adopted in accordance with procedures established by the department and shall include all of the following: (b) Medical protocols to ensure the appropriate dispatching of a life support agency based upon medical need and the capability of the emergency medical services system.
Regional Plan Development and LMCA Protocols • A effective regional plan will depend on a coordinated EMS/hospital system -- which is a key reason LMCA’s are involved. • LMCA within the region will be required to implement the regional plan through the adoption of protocols. • The development of a regional plan and adoption of protocols has the same protections under Part 209 as other protocol development and implementation.
Liability revisions under Act 375 (2000) Sec. 20965(3)Unless an act or omission is the result of gross negligence or willful misconduct, the acts or omissions of any of the persons named below,while participating in the development of protocols under this part, implementation of protocols under this part, or holding a participant in the emergency medical services system accountable for department-approved protocols under this part, does not impose liability in the performance of those functions:
Persons Protected by Section 20965(3) • A participating hospital or freestanding surgical outpatient facility in the medical control authority or an officer, member of the medical staff, or other employee of the hospital or FSSOF. • A participating agency in the medical control authority or an officer, member of the medical staff, or other employee of the participating agency.
Persons Protected by Section 20965(3), cont. • A nonprofit corporation that performs the functions of a medical control authority. • The medical director and individuals serving on the governing board, advisory body, or committees of the medical control authority or employees of the medical control authority.
