Patent Office in Chandigarh | Patent Search and Analytics

A patent application typically goes through a rigorous examination process before being granted by the respective patent office(s). Occasionally though, some relevant prior art documents may be missed out during the examination process. This oversight may be rectified by bringing the relevant documents to the attention of the examining authorities in a timely manner. A search focused on identifying such relevant prior art documents is termed invalidation search, and it serves as one of the key steps in the whole invalidation process (also sometimes known as opposition proceedings in some countries). 3. NOVELTY A simple, cost-effective search with the object of finding the most relevant prior art related to a potentially patentable idea. Typically done on a suitable patent database involving minimum expense, it involves a technically qualified patent professional(s) to understand the idea presented, subsequently formulate a quick search strategy designed to churn out the relevant documents in the fastest manner possible. While it is ideal to perform this search at an early stage of idea conception, it can be conducted at any stage during proof-of-concept or development stage, but most definitely prior to filing a patent application. An early novelty search would reveal any potential threats thus reducing wastage of valuable resources. Such a search can also be used to refine or modify the idea to improve the final solution.

  4. PATENTABILITY For any idea to qualify as an invention, it needs to satisfy 3 main criteria viz. novelty, inventive step or obviousness, and industrial applicability or utility. The main purpose of a patentability search is to identify if the idea satisfies the criteria to qualify as an invention through the identification of relevant patents and non-patent literature. Through this search, the novelty and inventiveness of an invention, or lack thereof, may be established. Another consequence of a patentability search is also to enable refining a patent application in terms of defining the claims or enhancing the support for the claims in the description or specification.

  5. INVALIDATION A patent application typically goes through a rigorous examination process before being granted by the respective patent office(s).
