Chapter 1Scope and Administration • Chapter 1 has historically been re-written by Kentucky so as to address Kentucky specific needs and interests regarding building construction and code application. • The 2013 KBC follows the same formatting as the 2012 IBC. • Many of the KY amendments to Chapter 1 is code text carried forward from the previous edition and many you have seen since the1980 edition of the KBC. However, there are a few new sections we will review.

  4. The underscored language is not new to the code but is new to the KBC. The 2013 KBC no longer deletes this text. The new language extends the codes intent beyond that of establishing safeguards for the public and building occupants. It extends application to the protection of our fire fighters and first responders during any emergency operation and event. 2007 KBC 2013 KBC Section 101.3 Purpose IBC text was deleted as an amendment to create this section in the 2007 edition. New text added via IBC Section 101.3 Intent. The purpose of this code is to establish the minimum/maximum requirements … and safety to life and property from fire and other hazards attributed to the built environment and to provide safety to fire fighters and emergency responders during emergency operations.

Except for compliance with Chapter 16, this new exception seems to exempt all industrialized buildings from compliance with all other provisions of the code. 2007 KBC 2013 KBC 102.6.1 Moved structures. Buildings and structures moved into or within … New exception added via KY amendment. 102.6.1 Moved structures. Buildings and structures moved into or within the Commonwealth shall comply with the provisions of this code for new buildings and structures … This provision does not apply to manufactured homes. Exception: Industrialized buildings moved into or within the jurisdiction meeting the requirements of Chapter 16 of this code.

Section 104.15.7 added for clarity and better understanding as to when a mixed use building is local jurisdiction.Section 104.15.8 added to clarify exemption from local jurisdiction those buildings built on state owned property. 2007 KBC 2013 KBC 104.15.8 State-owned buildings. Buildings owned by the Commonwealth shall not be subject to local plan review, inspection or approval, regardless of size, occupant load or occupancy. New text added via KY amendment. 104.15.7 Mixed occupancies. All buildings containing more than one occupancy with a total occupant load that does not exceed 100. 104.15.8 State owned property.Buildings owned by or built on property owned by the Commonwealth shall not be subject to local plan review, inspection or approval, regardless of size, occupant load or occupancy.

  7. Like 104.15.7 and 104.15.8, both these amendments added for clarity and better understanding of jurisdictional thresholds. 2007 KBC 2013 KBC 104.1.7 State-owned buildings. Buildings owned by the Commonwealth regardless of occupancy classification or size. New text added via KY amendment. 104.16.7 Mixed occupancies. All buildings containing more than one occupancy with a total occupant load that does not exceed 100. 104.16.8 State owned property. Buildings owned by or built on property owned by the Commonwealth regardless of occupancy classification or size.

  8. 2013 KBC New code language via the 2009 IBC SECTION 106 FLOOR AND ROOF DESIGN LOADS 106.1 Live loads posted. Where the live loads for which each floor or portion thereof of a commercial or industrial building is or has been designed to exceed 50 psf (2.40 kN/m2), such design live loads shall be conspicuously posted by the owner in that part of each story in which they apply, using durable signs. It shall be unlawful to remove or deface such notices. 106.2 Issuance of certificate of occupancy. A certificate of occupancy required by Section 111 shall not be issued until the floor load signs, required by Section 106.1, have been installed.

KRS 322ENGINEERS LAW 322.360 Public work required to be done under professional engineer or licensed architect. • Neither the state nor any of its political subdivisions shall engage in the construction of any public work involving engineering, unless the plans, specifications, and estimates have been prepared and the construction executed under the direct supervision of a professional engineer or a licensed architect. • Subsection (1) of this section shall not apply to any public work, including a highway or capital project under KRS 56.491, that involves only maintenance or repair of the facility. Maintenance or repair shall not include any work which alters, modifies, or changes the original characteristics of the design.

  10. KRS 323ARCHITECTS LAW 323.033 Buildings requiring services of licensed architect. (5) Neither the state nor any of its political subdivisions shall engage in the construction of any public work involving the practice of architecture or engineering unless the plans, specifications, and estimates have been prepared and the administration of construction contracts executed under the direct supervision of a licensed architect or a professional engineer. This subsection shall not apply to: (a) Any public work, including a building or capital project under KRS 56.491, that involves only maintenance or repair of the facility. Maintenance or repair shall not include any work which alters, modifies, or changes the original characteristics of the design; or (b) Any residential dwelling that falls under the Kentucky Residential Code.

  12. Chapter 2Definitions Following the 2012 IBC format, all definitions are once again located in Chapter 2. Also returning to the code via 2009 IBC changes, the use of italics to identify defined terms. Where terms appear in both the IBC and KBC, the corresponding definition found in the KBC shall supersede.

Chapter 3Use and Occupancy Classification • Chapter 3 establishes the occupancy classification, single occupancy or mixed occupancy, which is necessary to apply many of the requirements of the code. • A building, room or space intended to be used for different uses at different times shall comply with all code requirements applicable for each occupancy type.

Section 303Assembly Group A • A-1: theaters, concert halls • A-2: uses intended for consumption of food and/or drink; restaurants, bars, casinos • A-3: uses intended for worship, recreation, other assembly purposes not classified elsewhere; churches, courtrooms, funeral parlors, indoor sports facilities with no spectator seating • A-4: indoor sporting venues with spectator seating • A-5: participation in or viewing outdoor activities

  28. Chapter 4Changes via the 2009 and 2012 IBC • Section 402 Mall Buildings • Open Mall. An unroofed pedestrian way serving a number of tenants not exceeding 3 levels … • Open Mall Building. Several structures housing a number of tenants, such as retail stores, drinking and dining establishments, entertainment and amusement facilities, offices, and other similar uses, wherein 2 or more tenants have a main entrance into one or more open malls. Anchor buildings are not considered as part of the open mall building.

  29. Section 402 Mall Buildings • The new provisions permit open mall buildings to be treated the same as covered mall buildings. • A perimeter line must be established around an open mall bldg defining the extent of the open mall bldg. Parking garages and anchor bldgs shall be outside perimeter line and are not considered part of open mall bldg

Section 403High-Rise Buildings • 2009 and 2012 IBC Changes Modifications to section made as result of info learned from post 9/11 terrorism study • Bond strength for spray on fire proofing increased – 403.2.4 • Fire pump water supply must be from two different sources – 403.3.2 • Smoke removal system required – 403.4.7 • Interior exit stairways to be separated at least 30 feet or ¼ of the diagonal, which ever is less – 403.5.1 • Luminous egress path markings required – 403.5.5 • Bldgs more than 120 feet in height must have 2 fire service access elevators – 403.6.1 • Occupant self-evacuation elevators permitted to be installed – 403.6.2 • New provisions only for high-rise buildings exceeding 420 feet in height

Section 422Ambulatory Care Facilities KY amendment defines “Ambulatory Care Facility” • Non-licensed clinics per 902 KAR 20:073 are Group B Occupancy and therefore subject to the special provisions of this section Non-licensed facilities: • Separation – with potential for 4 or more patients incapable of self-preservation, facility separated from other tenants and corridors by fire partition • Create smoke compartments when exceeding 10,000 sf with no compartment > 22,500 sf • Create area of refuge • Independent egress from each smoke compartment • Automatic sprinklers per Section 903.2.2 • Fire alarm per 907.2.2.1

  32. Section 423Storm Shelters • Constructed to ICC-500 standard • Applies to shelters constructed as separate detached buildings or safe rooms within buildings to be used as safe refuge

Section 424 Children’s Play Structures • 2009 and 2012 IBC Changes • Children’s play structures installed in all occupancies regulated by this code shall comply with this section when: • Exceeding 10 feet in height and • 150 square feet in area • Maximum 300 square feet in area unless special investigation, approved by building official, demonstrates adequate fire safety

Section 429Consumer Fireworks Retail Sales • KY amendments • Shall comply with Group M and provisions of NFPA 1124. • Not applicable to buildings used for storage of consumer fireworks • Identifies 2 types of “Consumer Fireworks Retail Sales Facility” • Permanent buildings • Used primarily for sale of consumer fireworks in detached stand alone buildings • Must comply with specified sections of NFPA 1124 • Temporary Structures • Tents, Stands, Canopy or membrane structures • Must comply with specified sections of NFPA 1124

Section 430Temporary Structures • All temporary structures, tents, canopies and membrane structures erected for less than 180 days regulated by this new section. • All tents > 400 sf submitted to DHBC for model approval or on an individual use basis • Exceptions include; • Recreational tents • Fabric canopies up to 700 sf • Private event “Event involves use of temporary structures not open to public, no charge for admission and occupied by less than 1000”

Chapter 5General Building Heights and Areas • This chapter regulates the height and area of buildings erected and additions to existing buildings. • KY amendments seen in past editions of KBC are continued in 2013: • Day care centers (referring back to Table 425.13) • Open space limits (fire lane specifications per 503.2 of IFC) • Unlimited area buildings (exclusion of Type V construction) • Use Group R (1-hour horizontal assembly when above other occupancy)

  38. Section 501.2Address Numbers KY Amendments 2009 and 2012 IBC Changes Buildings shall have approved address numbers, building numbers or approved building identification placed in a position that is plainly legible and visible from the street or road fronting the property. These numbers shall contrast with their background. Address numbers shall be Arabic numerals or alphabetical letters. Numbers shall be a minimum 4” high with a minimum stroke width of 0.5”. New and existing buildings shall be provided with approved address numbers or letter. Each character shall be not less than 4” in height …. When required by the fire code official, address numbers shall be provided in additional approved locations to facilitate emergency response. Where access is by means of a private road and the building address cannot be virewed from the public way, a monument, pole or other approved sign or means shall be used to identify the structure. Address number shall be maintained.

Where the value of W varies along the perimeter of the building, the calculation performed in accordance with Equation 5-2 shall be based on the weighted average calculated in accordance with Equation 5-3 for portions of the exterior perimeter walls where the value of W is greater than 20 feet…W shall be measured perpendicular from the face of the building to the closest interior lot line. Where the building fronts on a public way, the entire width of the public way shall be used. Where two or more buildings are on the same lot, W shall be measured from the exterior face of each building to the opposing exterior face of each adjacent building, as applicable.
