  21. UN HUMAN RIGHTS CODE To fall in line with the U.N declaration of human rights:1. We should remove from our statutes, all laws that can be interpreted as making homosexuality a crime. 2. Discrimination against someone for his or her sexual preferences should be made illegal where the sex is between two consenting adults. 3. Public attitudes should change. For instance, teachers in state schools shall not be allowed to teach hatred based on a person's sexual preferences.

  29. HOMOSEXUALITY AND THE BIBLE • There are a number of direct references to homosexual activity in the Bible. • These almost exclusively concern male homosexuality . In the Hebrew Bible (more specifically, in Mosaic law), male homosexuality is identified as an "abomination". • In the New Testament, Paul of Tarsus condemns arsenokoitēs, which term is related to male homosexuality, but open to some interpretation, as either any male homosexual acts, or more specifically male homosexual prostitution. • Paul also makes a possible allusion to female homosexuality when he refers to "unnatural relations" between women in the Epistle to the Romans

Greek ἄῤῥην / ἄρσην [arrhēn / • Greek has the word androkoitēs for this meaning. It is likely that arsenokoitēs is taken from the Septuagint (LXX) reading of Leviticus 20:13 where the root forms (Greek ἄῤῥην / ἄρσην [arrhēn / arsēn] and κοίτην [koitēn] both appear. • 1 TIMOTHY 1:9–10: • Now we know that the law is good, if one uses it legitimately. This means understanding that the law is laid down not for the innocent but for the lawless and disobedient, for the godless and sinful, for the unholy and profane, for those who kill their father or mother, for murderers, fornicators, arsenokoitēs, slave traders, liars, perjurers, and whatever else is contrary to the sound teaching that conforms to the glorious gospel of the blessed God, which he entrusted to me. 1 Timothy 1:8–10

THE LAWS OF GHANA • Section 104 (1) (b) of the Criminal code state, “Whoever has an unnatural carnal knowledge of any person of 16 years or over with his consent is guilty of a misdemeanor,” while (1) (a) of the same code, which makes reference to sodomy, states, “whoever has unnatural carnal knowledge of any person of the age 16 or over without his consent shall be liable on conviction to imprisonment for a term of not less than five years and not more than 25 years.”

GHANAIAN LAW • Under Ghanaian criminal law, same-sex sexual activity is illegal. • Chapter 6 of the Criminal Code, 1960, as amended by the Criminal Code (Amendment) Act, 2003, provides: • Section 104. Unnatural Carnal Knowledge. • (1) Whoever has unnatural carnal knowledge — • (a) of any person of the age of sixteen years or over without his consent shall be guilty of a first degree felony and shall be liable on conviction to imprisonment for a term of not less than five years and not more than twenty-five years; or • (b) of any person of sixteen years or over with his consent is guilty of a misdemeanour; or • (c) of any animal is guilty of a misdemeanour. • (2) Unnatural carnal knowledge is sexual intercourse with a person in an unnatural manner or with an animal. • Under Section 99, "unnatural carnal knowledge shall be deemed complete upon proof of the least degree of penetration”.

GHANAIAN LAW • According to Section 296 of the Criminal Procedure Code, which applies because of Section 1 of the Criminal Code, a misdemeanour is punishable by imprisonment for not more than three years. • Whilst the law may not be actively enforced, reports suggest that instances of persecution are widespread and common. • Application to women • In 2017, a well-known lawyer, John Ndebugri challenged views on the illegality of lesbianism under Ghanaian law. According to him, lesbianism, which is also homosexuality, does not involve penetration with a penis and therefore cannot be described as sexual intercourse or unnatural, based on section 104 of the Criminal Code.]He added: "females don't have [sic] penis. They cannot penetrate," in a story published by MyJoyOnline. • Application to heterosexuals • The law also applies to straight people who have anal or oral sexThoughthe state "does not concern itself with this" because it is their private life, causing allegations of hypocrisy.

  42. CASE LAW • . By analogy, in Republic v. Atiso & Gligah, the Supreme Court held WRT “carnal knowledge” simpliciter, that “least degree of penetration” means anything that goes beyond what is generally referred to as “brushing.”

  44. Homosexual Health • One study concludes that 56% of  AIDS is found in 2% of the population, • As of June 2001, 64% of men with AIDS were men who have had sex with men. Bisexual  men become a bridge for  transmission of all these diseases to women and the rest of  the population according to Center For Disease Control.    In one CDC study 17% of  homosexual men had sex with men and women. Seven  percent  were HIV positive.

Balaban, a neurobiologist at the Neurosciences Institute in San Diego, noted that “  In recent years, researchers and the media have proclaimed the “discovery” of genes linked to alcoholism and mental illness as well as to homosexuality.  None of the claims...has been confirmed” (as quoted in Horgan, 1995).

HUMAN GENOME PROJECT • The human X and Y chromosomes (the two “sex” chromosomes) have been completely sequenced.  Thanks to work carried out by labs all across the globe, we know that the X chromosome contains 153 million base pairs, and harbors a total of 1168 genes (see NCBI, 2004).  The National Center for Biotechnology Information reports that the Y chromosome—which is much smaller—contains “only” 50 million base pairs, and is estimated to contain a mere 251 genes.  • NO GENES FOUND RELATED TO HOMOSEXUALS.

SIMON LE VAY • Simon LeVay—Brain Differences • The first “significant” published study that indicated a possible biological role for homosexuality came from Simon LeVay, who was then at the Salk Institute for Biological Studies in San Diego, California.  In 1991, Dr. LeVay reported subtle differences between the brains of homosexual and heterosexual men (1991).  LeVay measured a particular region of the brain (the interstitial nuclei of the anterior hypothalamus—INAH) in postmortem tissue of three distinct groups: (1) women; (2) men who were presumed to be heterosexual; (3) and homosexual

LeVAYS FINDINGS • LeVay’s Reported Findings • LeVay reported that clusters of these neurons (INAH) in homosexual men were the same size as clusters in women, both of which were significantly smaller than clusters in heterosexual men.  LeVay reported that the nuclei in INAH 3 were “more than twice as large in the heterosexual men as in the women.  It was also, however, more than twice as large in the heterosexual men as in the homosexual men” (1991, 253:1034).  This difference was interpreted as strong evidence of a biological link to homosexuality.  LeVay’s assumption was that homosexual urges can be biologically based—so long as cluster size is accepted as being genetically determined.
