Proposed Lead Standard • Final rule will be signed by October 15, 2008 • Final designations to be made by EPA in October 2011 • Mississippi has not monitored for lead since 1995 • Mississippi will likely be required to monitor at several sites, depending upon the final lead standard chosen.
Regional Haze Update • Went to Public Notice on June 16th and had a public hearing July 16, 2008. • Plan to go to Commission on August 28, 2008. • Supplemental SIP will need to be submitted in a year to address MS Phosphate and DuPont determinations.
CAIR & CAMR Vacatur • CAMR was vacated on Feb 8, 2008 • We only had four facilities affected by this rule • CAIR – Vacated July 2008 • MS Adopted both CAIR & CAMR by reference • Regional Haze SIP may have to be revised • Transport SIPs required by 110(a)(2) (d)(i) relied on CAIR • Will impact Ozone Attainment Planning • Waiting for more finality before any actions are taken
Boiler MACT Vacatur • Boiler MACT was vacated in June 2007 • MS does not believe that 112j applies • Waiting on Guidance from EPA regarding applicability of 112j • We have a list of Q& A regarding the boiler MACT on our website
Area Source MACT • EPA has promulgated Area Source MACT Standards covering 45 of the 70 source categories. • MS is sending surveys out for these Area source categories. • This has been a very resource intensive process.
Lead Based Paint - RRP • EPA published the Lead Renovation, Repair and Painting (RRP) Program on April 22, 2008. • MS is planning on accepting the RRP program delegation • Extensive planning • By April 2010, training providers must be accredited, renovation firms and dust sampling technicians must be certified.
