Foreign Trade Rules 2007 • Published in the Daily Gazette on April 27, 2007. • Their legal term will now be from May 1st to April 30 of each year. • The Annexes of the 2006 Rules are going to be used until the new ones are published. • Annexes 2 – 16 were published on May 9, 2007 • Annexes 17 – 21 were published on May 14, 2007 • Annex 1 was published on May 16, 2007 • The terms Maquila and Pitex were substituted by IMMEX in all the corresponding Rules.

Foreign Trade Rules 2007 • Rule 2.2.1. 6) Importer´s Registry Enrollment Requirements Companies that are enrolled in the Electronics Importer’s Sector that import CD’s recorded and non recorded, and software, will have to renew their enrollment in the Registry during the month of March of each year, using a free letter presented before the General Customs Administration.

Abandoned goods at Customs 30 days are given to withdraw abandoned merchandise from the Customs compound when authorization is given to import them definitively. • Rule 2.6.5. Different tariff classifications in CO´s It is clarified by this Rule that the Certificates of Origin issued with a tariff classification different than the one used in Mexico due to the changes in the World Customs Organization is considered as valid as long as the description stated matches the one declared in the pedimento and the merchandise can be clearly indentified.

  5. ForeignTrade Rules 2007 • Rule 2.6.26. Simplified pedimento A simplified pedimento can be printed for the transporter’s copy, and for certified companies, automotive industries and duty free companies it can be printed also for the Customs and Customs Broker’s copies. The simplified pedimento has general information like pedimento code, RFC, name, address, total payment of taxes, and omits information like tariff classification, description, quantities and values.

Certified Companies Enrollment Requirements New types of companies can register as a Certified Company: • Chemical companies certified by ANIQ • Suppliers to companies that manufacture goods in the electric, electronic, automotive and autoparts sector that are registered as a Certified Company • Moving transportation companies

Certified Company Benefits • Certified Autoparts companies may prepare a consolidate monthly change of regime pedimento of all the parts and components transferred to automotive and autotransportation companies for the previous month, the pedimento has to be presented within the first ten days of each following month. • Certified IMMEX companies do not have to attach copy of the IMMEX program extension when rectifying a pedimento due to a change of tariff classification determined by Customs.

  8. Foreign Trade Rules 2007 • Rule 2.11.5. Provisional value for IMMEX When IMMEX companies use provisional values in their pedimentos, they do not have to state the code that corresponds to type of valuation method used, instead they have to declare “VP” in accordance with Annex 22

Considerations for the application of sanctions by part of Customs Authorities derived from declarations and documents Amendments to this rule were made in order to accept a little more flexibility by part of the Customs Authorities when issuing fines and sanctions.

Cancellation of Broker’s license for bad use of taxpayers information It will no longer be a reason of cancellation of the license if the fiscal address was incorrectly declared, as long as certain requirements are met, such as, that the importer does not fail to recognize the operation, that the address stated in the pedimento was registered before the date it was done, that the importer changed the address before the pedimento was done, that no taxes were omitted, that the goods correctly cleared Customs.

  11. Foreign Trade Rules 2007 • Rule 3.3.11. Transfer of good subject to quotas from a temporary import to a definitive import The obligation of presenting the pedimentos only in the Port of Entry where the IMMEX company transferring was located, was eliminated. This was just for textiles and apparel. • Rule 3.3.14. Donation of scrap and fixed assets The corresponding pedimentos can be presented quarterly. The prior notice does not have to be presented.

  12. Foreign Trade Rules 2007 • Rule 4.2 Samples The sample can be in a package as long as it is marked, broken or perforated. Toy samples can have a value of up to 50 dlls. and a maximum of 2 pieces per model can be imported

Foreign Trade Rules 2007 • Article Eight More time is given to companies that have a PROSEC program to rectify their import pedimentos of November 2000 through March 2006, this before January 1st 2008 • Article Nine IMMEX companies will continue using the formats, codes, identifiers that correspond to Maquila or Pitex, until June 30, 2007. • Article Fourteen No change yet on the fields in the export pedimento of commercial value, value added, until Annex 22 is published.
