  6. 2. Legislative Framework • Section 46 of the Local Government Municipal Systems Act, 2000 (Act 32 of 2000) provides for the municipality to compile an annual report as part of its performance management system which shall also consist of an annual performance report

Legislative Framework cont.……. • Section 121 of the Local Government Municipal Finance Management Act, 2003 (Act no 56 of 2003) provides that an annual report should provide a record of activities of the municipality as well as the performance of the budget including providing mechanisms to account to the local community

  21. 13. De Hoop dam developments • The De Hoop Dam Resource Management Plan (RMP) was approved in July 2017. The plan is subject to renewal after every 5 years. • The De Hoop Dam RMP will be reviewed in 2022. • The plan was approved with Business Plan which will be reviewed annually. • Implementation of the De Hoop Dam RMP and Business plan is awaiting finalisation of the MOU by DWS to be entered into between Department of Water and Sanitation (DWS) and SDM as implementing agent of the RMP. • The Municipality is engaging DWS to expedite finalisation of the MOU.

Spatial Planning and Land Use Management Act (SPLUMA) cont.…… • Sekhukhune District Municipality reestablished the Joint District Municipal Planning Tribunal(JDMPT) together with its four Local Municipalities in June 2018. • This Tribunal is meant to process all land development applications submitted to all Local Municipalities within the district. • The Tribunal sit quarterly to attend to all applications submitted.

LAND FOR MUNICIPAL OFFICES cont.…. • Sekhukhune District Municipality is in continuous negotiations with Bapedi ba Mamone Traditional Authority for the allocation of land of 10 hectors for the construction of District Municipal Offices. • The District secured two development consent and community resolution from two land claimants (Monama CW and Batlokwa Ba Mogodumo). • The two consents were then sent to the Limpopo office of the Regional Land Claims commissioner for them to issue a consolidated final development consent before engaging Bapedi Mamone Traditional Council on the agreement and their community resolution

OTHER LAND DEVELOPMENTS cont.…. • Council of Sekhukhune District Municipality continued to work with the established provincial inter-ministerial committee on Jane Furse and Makhuduthamaga Local Municipality to negotiate with other land owners/holders around Jane Furse to identify more land for development of integrated sustainable human settlements

SPATIAL DEVELOPMENT FRAMEWORK (SDF) cont.… • The Spatial Development Framework (SDF) is a core component of a the Municipality‘s economic, sectorial, spatial, social, institutional, environmental vision • SDM has in the 2017/18 financial year Developed/Review the SDF in terms chapter 4, section 20 of Spatial Planning and Land Use Management Act, 2013 (SPLUMA) (Act No.16 of 2013) stipulating that municipal spatial development framework must be prepared as part of a municipality’s integrated development plan.

Challenges on spatial development cont.… • Unresolved and competing land claims in the area threaten to destabilize future development. • Increasing number of Informal settlements and housing backlog as mining activities intensify • Competing land uses (i.e. mining and agriculture, Commercial, etc.) may cause spatial, social, environmental and economic constraints in future. • Poor environmental management • Land invasions
