Konare Immigration Lawyer -------------------------------------------------------------------------------------------------------------------------------------------------------- Have you heard of Deferred Action for Parental Accountability (DAPA)? This program, announced in November 2014, provides temporary protection to certain immigrant parents of children with U.S. citizenship or lawful permanent residence. However, the program has been on hold since February 2015 when the case Texas v. United States was filed. The United States Supreme Court will hear the case on April 18, 2016 and a decision is expected by June 2016. If the Supreme Court decides in favour of DAPA, the program could go into effect as soon as late summer or early fall. What benefits does DAPA offer? DAPA provides temporary relief from deportation to certain undocumented immigrants who meet the qualifications listed below. In addition, DAPA recipients will receive a three-year, renewable work permit. DAPA could protect an estimated 5 million undocumented immigrants from deportation. You may be one of them! A PSG is a group that is identifiable by fundamental characteristics and is viewed as a threat in their home country. The said beliefs or characteristics must be so ingrained in them that it should not be expected that they can change them. You may qualify for DAPA if: 1.As of November 20, 2014, you have a son or daughter who is a U.S. citizen or lawful permanent resident; 2.You have continuously resided in the U.S. since before January 1, 2010; 3.You were physically present in the U.S. on November 20, 2016 AND at the time you make the request for DAPA; 4.You had no lawful status on November 20, 2014; and 5.You are not a priority for deportation under the DHS guidelines issued on November 20, 2014.
