Child custody CHILD CUSTODY BECOMES ONE OF THE MOST IMPORTANT CONCERNS WHEN A DIVORCE HAPPENS AND BOTH THE PARTNERS SHARE THE EQUAL RIGHTS OF CHILD CUSTODY. BUT UNDER SPECIAL CIRCUMSTANCES, THE COURT MAY GIVE LEGAL CUSTODY TO ONE PARENT ONLY. 5. JUDICIAL SEPARATION JUDICIAL SEPARATION IS A PROVISION WHERE A COUPLE LIVES SEPARATELY, DESPITE BEING MARRIED IN THE EYES OF LAW. THE JUDICIAL SEPARATION IS DECIDED BY THE COURT AND NOT THE COUPLE.
