DELIVERY ORDERS Delivery Orders and Task Orders are issued to initiate specific orders for services or supplies after award of an Indefinite Delivery Contract. • Delivery Order - provides for the issuance of orders for supplies during the performance of the contract. • Task Order - provides for the issuance of orders for servicesduring the performance of the contract.

DELIVERY ORDERS • Three types of Indefinite Delivery Contracts • Definite Quantity • Requirements Contracts • Indefinite Quantity Contracts • Pricing Structure • All pricing structures available for other contracts can be used. Contracts may contain more that one structure. • CPFF • FFP • Hybrid

DELIVERY ORDERS • Definite-Quantity • Exact quantity of specific supplies or services for fixed period with deliverables to be scheduled. • Requirements Contracts • Fill all actual purchase requirements of the government activity for the supplies or services during the contract period. • Indefinite Quantity • Unspecified quantity, within stated limits, of supplies or services to be furnished during a fixed period.

  5. DELIVERY ORDERS • Multi-Award • FASA makes preference to multiple award, not a requirement. • All contractors must have similar capabilities to ensure meaningful competition. • Multi-Awards should not be made to contractor’s specializing in different areas.

  6. Delivery Orders • Single Award • Only one contractor capable of providing because supply/services is unique or highly specialized. • CO determines more favorable terms and conditions will be provided with a single award. • Cost of administration of multiple contracts outweighs potential benefits. • Tasks to be awarded are so integrally related that only a single contractor can perform. • Total estimated value is less than simplified acquisition threshold.

  7. DELIVERY ORDERS • Delivery/Task Orders Under Multi-Award • Exempt from FAR part 6 • CICA met with original competition • Synopsis not required

DELIVERY ORDERS • FAR Part 16.5 - All awardees should have a Fair Opportunity to Compete unless: • Order is less than $2500 • Urgent and compelling need • Only one contractor capable of providing; supplies/services are unique of highly specialized. Strongly discouraged as all contractors should have similar capabilities. • Sole-source is in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided all awardees were given a fair opportunity to be considered on the original award. • Order is necessary to satisfy minimum order guarantee.

  9. DELIVERY ORDERS • Funding - Anti Deficiency Act • Funds necessary for any minimum quantity contained in the contract must be obligated at the time of award. • Orders in excess of the minimum, or for all orders if no minimum is specified, funds must be obligated when the order is issued.

  10. DELIVERY ORDERS • Issuing Request for Quote • Clearly defined Statement of Work for service or supply • Performance based SOW • Completion form SOW • JSC Standard Form 18 - RFQ • JSC Form 1429 - Order for Supplies or Services

  11. DELIVERY ORDERS • Selection Criteria • All evaluation factors and the relative importance must be clearly stated in the RFQ. Examples: • Past performance on previous tasks • Quality • Price/Cost • Technical Approach

  12. DELIVERY ORDERS • Streamlined Process • Proposals • Oral • Written • Discussions • Formal evaluation plans or scoring not required • Selection must be properly documented. Including: • Cost and Technical Evaluation • Selection Statement • Price must be considered along with other factors and documented. • Sole-source or follow-on work must meet FAR requirements. See 16.505.

DELIVERY ORDER • Issuing Delivery/Task Order • Clearly defined Statement of Work for service or supply • JSC Form 1429 - Order for Supplies or Services Must contain: • Date of order • Contract Number and order number • Item number and description, quantity and unit price • Price or Estimated Cost and Fee • Delivery date or Period of Performance • Place of delivery • Packing and shipping instructions • Accounting and appropriations data

  14. DELIVERY ORDERS • Debriefs • No statutory requirements for a formal debrief. • Protests • No protest under Subpart 33.1 is authorized in connection with the issuance of a Delivery/Task Order. Unless the Order increases the scope, period or maximum value of the contract.

  15. DELIVERY ORDERS • Legal Enforceability • Delivery/Task Orders are tied to the basic contract and carry all of the terms and conditions of that contract. • Delivery/Task Order Contracts are severable contracts. A default involving a severable order may permit the default termination only of that Delivery/Task Order. Only if the default brings into question the contractor’s ability to perform in general can the entire contract be terminated.
