Legislative Milestones PARC Decree (Pennsylvania ARC vs. Commonwealth of PA), 1971 Section 504 of Rehabilitation Act of 1973 Education for All Handicapped Children Act of 1975 (Public Law 94-142) Later renamed “Individuals with Disabilities Education Act” (IDEA); reauthorized in 1997 and 2004 Americans with Disabilities Act of 1991

    5. Individuals with Disabilities Education Act Guarantees free and Appropriate Education (FAPE) in Least Restrictive Environment (LRE) Assures rights of child and parents Assists states and localities to pay for special education Assures and assesses the delivery of special education

    6. Individual Education Program (IEP) Written education plan for a student who is eligible for special education services Includes: Goals and objectives Related services Supplementary aids and services Program modifications Specially designed instruction

    22. Eligibility for Special Education Services Parent or educator asks for an evaluation If student is deemed eligible for services, the child’s “education team” develops an Individualized Education Plan (IEP) and decides placement
