Compromise of 1850 1. Congress would admit California as a free state 2. The people of the territories of New Mexico and Utah would decide for themselves whether slavery would be legal 3. Congress would abolish the sale of enslaved people in Washington, D.C. 4. Slavery itself would remain legal in Washington, D.C. 5. The Fugitive Slave Act would order all citizens of the United States to assist in the return of enslaved people who had escaped from their owners. It would also deny a jury trial to escaped slaves.

Buchanan inadequately grasped the political realities of the time • Failed to understand that the North would not accept constitutional arguments which favored the South • The Democrats SPLIT which gives rise to the republicans. • Sectional strife rose to such a pitch in 1860 that the Democratic Party split into northern and southern wings, each nominating its own candidate for the Presidency • President Buchanan, dismayed and hesitant, denied the legal right of states to secede but held that the Federal Government legally could not prevent them. In the words of Henry Clay “The moral lights would be blown out around us.” -Abraham Lincoln Lincoln wasn’t for TOTAL equality, yet. But he did attempt to make people see the basics of the situation of slavery. “I agree with Judge Douglas he is not my equal in many respects—certainly not in color, perhaps not in moral or intellectual endowment. But in the right to eat the bread, without the leave of anybody else, which his own hand earns, he is my equal and the equal of Judge Douglas, and the equal of every living man.”
