  1. How the FMCSA Drug and Alcohol Program Affects Your CDL and Insurance If you are a commercial truck or bus driver, you are subject to the Federal Motor Carrier Safety Administration (FMCSA) drug and alcohol program. This program requires you to undergo testing for certain substances before and during your employment and comply with the Department of Transportation (DOT) rules and regulations. Failing or refusing a test, or violating any other drug and alcohol regulation, can have serious consequences. Here are some of the ways that the FMCSA drug and alcohol program affects your CDL and insurance:

  2. 1.CDL Suspension or Revocation Testing positive or refusing drugs or alcohol tests will get you off duty and banned from driving a CMV. You will be in the FMCSA Clearinghouse, which tells your SDLA to suspend or revoke your CDL. You need an SAP evaluation, a negative RTD drug test, and a follow-up plan to regain your CDL. 2. Insurance Premium Increase or Cancellation Violating the FMCSA drug and alcohol program can raise or cancel your insurance. Insurers see drivers with violations as risky and charge more or deny coverage. A survey showed that drivers with violations paid 51% more for insurance than drivers without violations. 3. Legal and Financial Penalties In addition to losing your CDL and insurance, you may also face legal and financial penalties for violating the FMCSA drug and alcohol program. Depending on the severity and frequency of your violation, you may be fined, jailed, or both. For example, driving a CMV while under the influence of drugs or alcohol is a criminal offense that can result in a fine of up to $25,000, imprisonment for up to one year, or both.
