Senate Bill 1458 • Signed by governor 6/17/2005 • Effective 1/1/2006 • Municipalities must implement requirements by 1/1/06 • Modifies Section 214 of the Local Government Code • “… the International Building Code, as it existed on May 1, 2003, is adopted as a municipal commercial building code in this state.”

  3. Senate Bill 1458 • Applies to new construction, alteration, remodeling, enlargement, or repair in commercial buildings • Commercial building: building for the use or occupation of people for: • A public purpose or economic gain; or • A residence if the building is a multifamily residence that is not defined as residential by this section

Senate Bill 1458 • Municipality can: • Adopt local amendments • Establish procedures for administration and enforcement • Consider amendments made by ICC after May 1, 2003 • Keep a code considered more stringent than 2003 IBC if adopted before Jan. 1, 2006. They can also adopt future editions of that code

  10. Reporting of Incidents • No person shall, by verbal or written directive, require any delay in the reporting of a fire or unauthorized chemical release to the fire department • Upon activation of a fire alarm signal, employees or staff shall immediately notify the fire department

  11. High Rise AEDs • Automatic External Defibrillator required on each occupied floor • Type approved by AFD • Available for public use • Placed in elevator lobby unless AFD approved

  12. Private Fire Hydrants • Annual flow test, inspection and maintenance • 508.3.5 sets standards for testing Allowable Sprinkler Systems • Allowance for NFPA 13D system in large I-1 facilities deleted

  13. Commercial Cooking Exception • Intermittent use (less than 6 hrs per week) • Does NOT have to have fire suppression system • Must have Class 2 vent hood • Must have portable extinguisher rated for commercial cooking applications*

  14. Fire Extinguishers • Exception for A, B, and E occupancies with QR sprinklers eliminated • Class K extinguishers now required for commercial cooking areas • 40B:C no longer permitted in areas using fats/oils in the cooking process

  15. Occupant Load • Increases in occupant load is allowable if the building meets all other requirements of the code based on the increased load the overall occupant load factor doesn't drop below 7 square foot per person

  16. Means of Egress • Factors for determining capacity of a means of egress limited to following: • .3 inches in stairways • .2 inches all others (TABLE 1005.1 deleted) • Panic hardware required in Group A and E at OL of 50+

  17. Means of Egress • Minimum escape window openings increased to 5.7 square feet with minimum clear opening of 24 inches • Section 1008.1.3.4 deleted • Access-controlled egress doors • Delay egress can be in buildings with sprinkler OR automatic detection • Except Group A, E, H
