Procedure for the definite stop and the moving into the monitoring phase (articles 42 to 45 of the INB procedure “décret” ) • The request for autorisation and the associated « dossier » are submitted to the same type of inuqiries as is the request for the authorization of a creation of an INB (see previous slides). • The “décret” authorising the definite stop and the moving into the monitoring phase of the facility: • Describes the main elements of the final stopping operations and the tasks for which the operator is responsible after the stop, with respect to safety, health and public helth or protection of nature and the environment • Gives the time in which the passing to the surveillance phase must be done • Can change the initial creation “décret” for the facility to adapt, in coherence with the operational progress, the frequency of the safety reviews or the perimeter of the facility and set the conditions to which the facility is assigned. 3. The progressive approachtowards passive surveillance: • An obligation of « means »: • Article 8 of the n° 2003-30 décret : • 6 years at the latest after the publication of this « decret » (…), the operator will produce for the Safety Authority the final safety report for the facility and a revision of : • the operating rules • the internal plan in case of emergency • the monitoring plan . • At this time, the operator will produce a report on the usefulness of putting a new, more durable, cover in place . This cover would insure the long term safety of the facility. • The facility will be considered as being operational once the ministers responsible for the environment and industry will have decided it, on the basis of the final safety report, the operating rules , the internal plan in case of emergency and the monitoring plan.
