  3. Wat do National Statistics show? • 7.1% have a disability (*) • 41% of them are of working age (18 to 60 years) 25% 75% • 75% persons with disabilities are unemployed Data compiled by ENDI: National Disability Survey, 2002-2003 (*) According to 2010 National Census: PwD 12.9%

  4. How has the global community influenced Argentina • Argentina has adhered to the UNConvention on the Rights of Persons with Disabilities and the optional Protocol Ratified by Law 26.378, 2008

  5. Government initiatives 1. Creation of Persons with Disability Observatory. 2. Directorate for the Promotion of Employment of Workers with Disabilities 3. Laws and benefits that promote the hiring of persons with disabilities 4. Systems of guarantees of public employment for persons with disabilities

Persons with Disability Observatory • Created in 2011 • FunctionswithintheCONADISframework (National Council fortheIntegration of PeoplewithDisabilities) • Organized in Workgroups: GO + NGOs • Role: to monitor the implementation and enforcement of the UN Convention • Submits reports to the UN

  7. 2.Directorate for the Promotion of Workers with Disabilities –MTEySS (*)- • Since 2003: Measures and Programmes that support job inclusion for Workers with Disabilities. • Since 2007: Selective Employment Areas through Municipal Employment Agencies Employment Service Network (*) MTEySS: Department of Labour Employment and Social Security • Objetive: to seek equal job opportunities for Workers with Disabilities

Employment Service Network -2005- • Groups all Municipal Employment Agencies in the country and puts them in touch with the MTEySS • Goal: to ensure liaison between Individuals with Disabilities & Employers • Seeks to expand labour inclusion Programmes Nationwide 2012: + 450 Municipal Employment Agencies in the country

  9. NationalGovermentProgrammes- MTEySS- • To Promote Equal Job Opportunities Res. SE 1365/12 • Special Programme for Training and Technical Assistance for Employment • Program of Labour Inclusion for People with Disabilities Offers attractive incentives to employers who hire Persons with Disabilities Includes Groups in Vulnerable Social Situation

Programme of Job Training for Workers with Disabilities (for Public and Private Sector and non-profit organizations) • Programme of Financial Support to Sheltered Workshops • Programme of Labour Inclusion in the Sheltered and Open Labour Market, Law 25.730 (also called Cheque Law). • Programme of Financial Support for Microenterprises for Workers with Disabilities However none directly fund Supported Employment

  11. 3.Laws and benefits that promote the hiring of persons with disabilities Law 22.431: special tax deduction on income tax liability or on capital equal to 70% of the total wages of all persons with disabilities employed in the company. Law 24013: employers will be exempted from the payment of 50% of the Contributions to Social Services, for the period of 1 year.

  12. Law 26.476: Employers receive a reduction in their contributions to Social Security: - 1st year payment of 50% of the contributions - 2nd year payment of 75% of the contributions Law 24.147: Deduction of 50% in employer payroll tax contributions by hiring Sheltered Labour Groups

  13. 4.Systems of guarantees of public employment for persons with disabilities Law 25.689: Public Sector must include at least 4% of Persons with Disabilities in their staff and reserve jobs to be exclusively occupied by Persons with Disabilities. Law 1.502 (Buenos Aires City): is obliged to employ a minimum of 5% of Persons with Disabilities in the Public Sector the Autonomous City of Buenos Aires

  14. How do Companies react? • There has been a gradual change for the better • Club of Committed Companies (Committed to employ Persons with Disabilities) • Corporate Social Responsability • Negative Acttitudes: Doubts, queries, worries, etc hiring Persons with Disabilities

Where do these concerns stem from? • Uncertainly due to the current economic climate • Legal matters & Discrimination • Prejudice, ignorance and so forth (*) reported by the National Council on Integration of PwD (2010) The attitude of the employers changed after hiring a person with disability (*)

  16. 2005 Statistics • 84.2% Believe job inclusion in their Companies is possible • 10.5% Stated the opposite • 5.3% Give no opinion 10.5% 84.2% 45.6% declared that they had taken steps to integrate PwD

What is the relationship between the Companies & SE • Growing interest to avail themselves of the Supported Employment Services • Considered as a valuable tool to fulfil Corporate Social Responsibility • Added value to their corporate image • Argentine Businesses are aware that Supported Employment conforms with their quality standards and has worldwide recognition

Who are the other agents? • Persons with Disabilities: Have adopted a critical role in standing up for their Rights to be fully integrated into society: Conferences, Seminars, etc. • Families: - Head and/or support the demands of their relatives to enjoy their Rights - Apprehensive, fear they lose disability pension benefits • Society: - Inclusive Versuss Paternalistic/Social Stigma attached to Disability - Public awareness campaigns (Private & Public Sector- NGOs)

Service Provider Institutions: - New organizations structure their services to offer SE - Others have to restructure their services to adopt SE • NGOs: - National & International - Safeguard the paramount righs of PwD to be fully integrated into society - Active participation in special programmes and policy implementation - Pioneers in using Supported Employment

Current Status of SE • Background Information • Argentina is one of the pioneers in Latin American • Concentrated mainly in major cities (Córdoba, Mendoza, Buenos Aires, etc.) • NGOs took the first steps followed by private institutions and organizations Late entry of SE in Argentina compared to others regions

Public organizations: currently more committed to labour inclusion but don´t especially use SE Methodology Some SE guidelines observed (eg: Employment Service Network) • SE Focus:Persons with Disabilities, especially Intellectual Disabilities. • No existing records of Supported Employment in Groups in Vulnerable Social Situation

How is Supported Employment financed? • Through goverment programmes and iniciatives aimed at PwD in general wich could work in favour of Supported Employment • Business Sector Donations • Internal institutional administration • Employers cover costs • Special programmes funded by private organizations and NGOs (both Nacional & International)

What´s the difference between SE & ShE SE ShE Regulated by Law 26.816 "Federal Regime of Sheltered Workshops for Persons with Disabilities", 2013 Special governments programmes to fund ShE • Lacks legal framework • Lacks specific government programmes aimed at SE Programmes aimed at disabled population in general could benefit SE

  24. SE ShE Direct funding. Workers of sheltered workshop have access to the retirements and pensions system Grouped through FETAP (*) Workers not integrated with society (*) (Federation of Sheltered Workshops) • Major drawback: Lacks direct & regular funding • Workers in the open labour market usually forfeitthe access to the retirement and pension system • Lacks a National Association • To guarantees PwD Legal & Moral Rights to work as regular citizen

SE: Challenges ahead • To strengthen public polices that directly benefit SE • To press for the development and implementation of more polices and legislation that encourage labour inclusion through SE. • To guarantee direct and regular funding for SE • To intensify controls to make sure existing laws and initiatives are observed • To ensure all SE Processes achieve High Quality Standard

To review and overhaul the retirements and pensions systems related to Persons with Disabilities. • To form a National Association of SE • To heighten awareness in businesses and society in general, and inform them • To Educate the families about the benefits of inclusion in the open labour market through Supported Employment • To set up and supervise programmes for job coaches and providers of SE Services

To foster up cooperation with academic organizations in the research and promotion of Supported Employment • Compilation of a data base with information regarding Supported Employment variables Our fundamental aim is the advancement and efficient use of Supported Employment throughout the country
