Air & Waste Management Association 2008 Southern Section Annual Meeting & Technical ConferenceAugust 6, 2008 Dick Schutt, Chief Air Planning Branch Region 4 Air, Pesticides and Toxics Management Division
Achieving Cleaner AirAir Regulatory Update Topics • Overview of the Southeast Air Quality • Regulatory Challenges • New & Upcoming Rulemaking • Opportunities for Collaborations/Partnerships
Region 4 Designated PM2.5 Nonattainment and Unclassifiable Areas for 1997 Annual Standard
Areas/Sites Violating Revised (2006) 24-Hour PM2.5 NAAQS (based on 2004-2006 data) • Current nonattainment area (NAA) violates 24-hr NAAQS [29 areas] • Current NAA meets 24-hr NAAQS [10 areas] • Sites in current NAA violate the 24-hr NAAQS [131 sites / 29 areas] • Sites not in a current NAA violate the 24-hr NAAQS [48 sites / 32 areas]
Lead NAAQS Review • May 1, 2008 – EPA proposed action to revise or retain current Pb NAAQS • Proposing to revise primary standard from 1.5µg/m3 to within the range of 0.10µg/m3 to 0.3µg/m3 August 4, 2008 - End of Public Comment period • October 15, 2008 – Final rule
Regional CAA Enforcement Updates • MACT Air Toxics • NSR/PSD
FY08 MACT Air ToxicsNational Sectors • Leak Detection and Repair • Flaring • Surface Coating
Air Toxics Region 4 Sectors - Ongoing • Secondary Aluminum MACT • Pesticides Active Ingredient MACT • Pharmaceutical Production MACT • Phosphoric Acid Mfg/Phosphate Fertilizer Production MACT • Leak Detection and Repair MACT Sectors
FY08 NSR/PSD National Sectors • Glass Manufacturing • Container, Flat, Fiber • Cement Manufacturing • Sulfuric Acid/Nitric Acid • Electric Utilities
Air Toxics • CAMR Vacturs • Major Source MACT Vacaturs • Area Source MACTS
CAIR Vacatur • CAIR in effect since June 2006 • EPA was sued by a small number of parties (one state, less than 20 power companies, and two small trade associations) on various aspects of CAIR • The Court issued its decision on July 11, 2008 to vacate both CAIR and the FIP in their entirety and sent the rules back to EPA
New Locomotive and Marine Diesel Rule • March 14, 2008- final rule issued • Reduce PM by 90% / NOx by 80% when implemented • Tightens standards for existing engines when remanufactured • Standards for new engines reflecting current emission reduction technologies • Locomotive idle reduction requirements • ULSD fuel (15 ppm) required in 2012
Mandatory GHG ReportingRulemaking • Objective - To collect comprehensive and accurate data relevant to future climate policy decisions, including potential future regulation under the Clean Air Act • Scope of Coverage - Define gases “…to require mandatory reporting of greenhouse gas emissions” (CO2, CH4, N2O, HFC, PFC, SF6) • Sections 114 & 208 of the CAA allow for data collection, measurement & recordkeeping from stationary or mobile related sources • Proposed rule expected by September 2008 and final rule by June 2009 • EPA welcomes stakeholder input and plans to reach out to stakeholders through information sharing sessions • http://www.epa.gov/climatechange/emissions/ghgrulemaking.html
Advance Notice of Proposed Rulemaking (ANPR) Greenhouse Gas Emissions • One of the steps EPA has taken in response to the U.S. Supreme Court’s decision in Massachusetts v. EPA • Seeks input on a variety of topics including potential regulatory approaches and technologies for reducing GHG emissions • ANPR published in the Federal Register on July 30, 2008 (comment period closes November 28, 2008)
Southeast Diesel Collaborativewww.southeastdiesel.org • Voluntary partnership to improve air quality and public health by reducing emissions from existing diesel engines • 3rd Annual Partners Meeting held June 23-25 in ATL • JOIN UP! 700+ members so far
2008 DERA Funding Update • SEDC will award $3.6M in 2008 • Project proposals were due June 12 – currently under competitive review • DERA State grants of $197K to $492K will be awarded in Sept (all 8 Region 4 States) • HQ grant competition for emerging technologies open now, closes Sept 21 • For more information: www.grants.gov or http://www.southeastdiesel.org/
