Surface Transportation Authorization Current program expires June 30 Senate • Passed S. 1813 – Moving Ahead for Progress in the 21st Century (MAP-21) House • Passed HR 4348 – The Surface Transportation Extension Act, Part II Senate and House have agreed to proceed to conference
Senate Bill • MPO planning • MPO population designation threshold raised to 200,000 • Creates 2 MPO Tiers • Tier I >1m in population • Tier II: 200k – 1M population • Instructs USDOT to issue a rulemaking to establish minimum requirements to be designated as Tier I or II • MPOs must meet requirements to continue • Performance based planning requirements for Tier I MPOs • Increases overall PL funding • Eliminates TE set-aside • Requires state to reserve, under CMAQ, an amount equivalent to 2009 TE set-aside for enhancement type projects • USDOT may consult with states to certify MPOs
House Bill • HR 7 approved in Committee 29-24. Did not have votes in full house (Chairman Mica wants HR 7) • MPO population designation threshold raised to 100,000 • Preserves all existing MPOs • Increases overall PL funding • TIP may be amended by Gov without MPO approval in cases of Interstate projects of state-wide significance • Eliminates TE set-aside • Reduces MPO suballocation of funds under STP • HR 4384 passed full house 293-127 • 90-day extension with current planning law (Clean extension) • Approval of Keystone XL pipeline permits • Environmental streamlining provisions contained in HR 7

What can we expect from Conference? • Two very different bills, plus HR 7 policy • 5 year vs. 2 year • Funding levels? • How to pay for the bill? • House position • Environmental Streamlining/Project Delivery • State assumption of Federal responsibility; reduce steps in the process; set hard deadlines for federal agencies; incorporate decisions made in planning without changes • XL Keystone Pipeline • in or out?
Key Steps for AMPO • Preserve all existing MPOs • New MPOs should be designated at 100,000 population • Suballocation of flexible funding under STP/TMP should remain at current percentages • Planning funds should not be reduced and should grow with core funding programs • Maintain dedicated funding from the HTF for transit • Preserve maximum flexibility under CMAQ • Preserve MPO decision-making authority regarding TIP • Maintain current certification process • Expand the role of MPOs in establishment and implementation of performance measures • Support timely reimbursement of planning funds • Support streamlining provisions while maintaining environmental safeguards
