New Law – OE TransportationAmending § 121.54(10) Wis. Stats. Old Law: A nonresident school district was prohibited from picking up an open enrolled student within the boundaries of the student’s resident school district. New Law: A nonresident school district is prohibited from picking up an open enrolled student within the boundaries of the student’s resident school district, unless the resident school district approves.
Required School Board PoliciesWis. Stats. § 118.51 (4) (a) 6. A school board is required to adopt policies specifying whether it will provide transportation to some or all of its nonresident or resident OE students and the methods by which it will provide the transportation.
Recommended Policy Amendment • It is recommended that each school board amend its policy to specify whether: • as a resident district, it will or will not allow nonresident districts to enter the district to pick up or drop off OE students, and the circumstances under which it will or will not do so. • as a nonresident district, it will or will not pick up students within their resident school districts, and the circumstances under which it will or will not do so.
