Philips CPAP lawsuits: What to do if respiratory support is hazardous? https://www.medlegal360.com/philips‐cpap‐lawsuits/  Thousands of claimants have started bringing Philips CPAP lawsuits against Philips Respironics, claiming  that the company's sleep apnea equipment caused serious health consequences ranging from cancer to  respiratory problems.  Philipscpaplawsuits     Philips CPAP lawsuits: What to do if respiratory support is hazardous? https://www.medlegal360.com/philips‐cpap‐lawsuits/  Obstructive sleep apnea is treated with CPAP, a piece of durable medical equipment. While sleeping,  people with sleep apnea abruptly stop breathing, but the device provides pressured air to the user  through a hose and mask system.  Millions of CPAP machines, BiPAP, and Ventilator equipment were recalled by Philips Respironics in June  2021 owing to potential health hazards, including possible cancer risk. The polyurethane foam with a  polyester basis (PE‐PUR) used in the recalled Philips CPAPs is the cause of the recall. According to reports,  the PE‐PUR foam can break down into tiny particles that might be swallowed or breathed, or it can release  chemicals that could have negative health consequences, including the potential to cause cancer.  A class action lawsuit was brought against Philips in Massachusetts in June 2021. According to the case,  Phillips was aware of the dangerous health effects the toxic foam inflicted on them for many years.  Consumers have reportedly been complaining about the issues for a while, but Philips didn't formally alert  the public until April 2021, according to specific reports. It took Philips another two months, until June 14,  2021, to officially recall the products.  Several CPAP lawsuits were filed against Philips in federal courts across the nation due to CPAP and BiPAP  safety. Early cases were not based on true torts for personal injuries or product liability. All of these  lawsuits so far fall under the category of consumer class actions. In Pennsylvania federal court, an MDL  was created in October 2021 for the Philips CPAP recall.  The first stage of the litigation process that initiates settlement talks is the establishment of an MDL. Once  the  MDL  has  been  established,  fact‐finding  and  trial  preparation  may  start,  opening  the  door  for  settlement negotiations. More than 300 litigations were still pending in the MDL as of May 16, 2022.  Philips CPAP lawsuits allege that the company knew or should have known about the possibly fatal health  risks of CPAP equipment but failed to warn doctors or patients. Since the recall was announced, the  manufacturer has been the subject of several claims. The company has allegedly been utilizing foam that  has been deemed potentially dangerous since 2009, according to the Philips CPAP recall lawsuits. The  cases against Philips CPAP center on charges of design fault and failure to warn.
