  7. LCPD (3) Art 4.6 MS can define and implement a national emission reduction plan for existing plants. Reduction of total annual emissions to a level of art 4.3 (“bubble”). The NERP may under no circumstances exempt a plant from the provisions laid down in relevant Community legislation including IPPC. Art 4.7 Not later than 31 Dec 2004 a report of the EC about further measures, amount of heavy metals, cost of further reductions, technical and feasibility of reductions etc

  8. LCPD (4) Art 5 Exemptions: Plants > 400 MWth with operation time < 2000 hours/year until 31 Dec 2015 with operation time < 1500 hours/year from 1 Jan 2015 SO2 ELV = 800 mg/m3

  9. LCPD (5) Art 6 Newest plants: examination of technical and economic feasibility of providing for the combined generation of heat and power and develop accordingly if feasibility is confirmed.

Art 7 Breakdown the plant In case of a breakdown competent authority shall require to reduce or close down operations if return within 24 hours or to operate the plant using low polluting fuels is not possible. In any 12-month period the cumulative duration of unabated operation shall in no circumstances exceed 120 hours. There are some exceptions LCPD (6)

  21. Compliance with the ELV laid down by LCPD should be regarded as a necessary but not sufficient condition for compliance with the requirements of IPPC regarding the use of BAT. Such compliance may involve more stringent ELV’s, ELV for other substances and other media and other appropriate conditions. NEC National emission ceilings LCPD Recital 8
