Prevention or correction of sex discrimination, including sexual harassment includes
The type, frequency, and duration of the conduct • Conduct that is not severe will not create a hostile environment. • e.g., a comment by one student to another student that she has a nice figure. Indeed, depending on the circumstances, this may not even be conduct of a sexual nature.
The identity of and relationship between the alleged harasser and the subject or subjects of the harassment.
The Identity of and Relationship between Harasser and Harassed
Common Sense and Reasonable Judgment It is the totality of the circumstances in which the behavior occurs that is critical in determining whether a hostile environment exists. Consequently, in using the factors discussed previously to evaluate incidents of alleged harassment, it is always important to use common sense and reasonable judgment in determining whether a sexually hostile environment has been created.
