Congress excluded three categories of law enforcement and national security records from the requirements of the FOIPA [5 U.S.C. § 552(c)]. Founded in 1908, the FBI carries out a dual law enforcement and national security mission. As part of this dual mission, the FBI creates and maintains records on various subjects; however, the FBI does not maintain records on every person, subject, or entity. (iii) Requests for Criminal History Records or Rap Sheets. The Criminal Justice Information Services (CJIS) Division provides Identity History Summary Checks – often referred to as a criminal history record or rap sheet. These criminal history records are not the same as material in an investigative “FBI file.” An Identity History Summary Check is a listing of information taken from fingerprint cards and documents submitted to the FBI in connection with arrests, federal employment, naturalization, or military service. EXPLANATION OF EXEMPTIONS SUBSECTIONS OF TITLE 5, UNITED STATES CODE, SECTION 552 (b)(1) (A) specifically authorized under criteria established by an Executive order to be kept secret in the interest of national defense or foreign policy and (B) are in fact properly classified to such Executive order; (b)(2) (b)(3) related solely to the internal personnel rules and practices of an agency; specifically exempted from disclosure by statute (other than section 552b of this title), provided that such statute (A) requires that the matters be withheld from the public in such a manner as to leave no discretion on issue, or (B) establishes particular criteria for withholding or refers to particular types of matters to be withheld; (b)(4) (b)(5) trade secrets and commercial or financial information obtained from a person and privileged or confidential; inter-agency or intra-agency memorandums or letters which would not be available by law to a party other than an agency in litigation with the agency; (b)(6) (b)(7) personnel and medical files and similar files the disclosure of which would constitute a clearly unwarranted invasion of personal privacy; records or information compiled for law enforcement purposes, but only to the extent that the production of such law enforcement records or information ( A ) could reasonably be expected to interfere with enforcement proceedings, ( B ) would deprive a person of a right to a fair trial or an impartial adjudication, ( C ) could reasonably be expected to constitute an unwarranted invasion of personal privacy, ( D ) could reasonably be expected to disclose the identity of confidential source, including a State, local, or foreign agency or authority or any private institution which furnished information on a confidential basis, and, in the case of record or information compiled by a criminal law enforcement authority in the course of a criminal investigation, or by an agency conducting a lawful national security intelligence investigation, information furnished by a confidential source, ( E ) would disclose techniques and procedures for law enforcement investigations or prosecutions, or would disclose guidelines for law enforcement investigations or prosecutions if such disclosure could reasonably be expected to risk circumvention of the law, or ( F ) could reasonably be expected to endanger the life or physical safety of any individual; (b)(8) contained in or related to examination, operating, or condition reports prepared by, on behalf of, or for the use of an agency responsible for the regulation or supervision of financial institutions; or (b)(9) geological and geophysical information and data, including maps, concerning wells. REQUEST FOR RECORDS 10/12/2021 decrease in the number of international students attending Westminster College; (14) formal and informal opinions held by your offices about the need for Westminster College to be further appealing to women and international students in order to better address their financial difficulties that have made many headlines; (15) your communications in the form of e-mails and postal correspondence about the appointment of Benjamin Akande as the 1st Black President of Westminster College;vii (16) your communications in the form of e-mails and postal correspondence about the tenure of Benjamin Akande as the 1st Black President of Westminster College;viii (17) your communications in the form of e-mails and postal correspondence about the appointment of Jahnae Barnett as the 1st woman President of William Woods University;ix (18) your communications in the form of e-mails and postal correspondence about the tenure of Jahnae Barnett as the 1st woman President of William Woods University;x (19) your communications in the form of e-mails and postal correspondence about 50% of marriages concluded in the 1980s ending in divorce; (20) your communications in the form of e-mails and postal correspondence about the declining divorce rate in the U.S.A; (21) your communications in the form of e-mails and postal correspondence about the divorce rate in the U.S.A being significant despite the partial decline; (22) your communications in the form of e-mails and postal correspondence about the suspiciousness of studies that have linked happiness with marriages and children; (23) your communications in the form of e-mails and postal correspondence about what constitutes happiness taking into consideration the non-negligible amount of divorce in the U.S.A; (24) your communications in the form of e-mails and postal correspondence about the U.S Declaration of Independence having noted that all men were endowed “by their Creator with certain unalienable Rights, that among these are Life, Liberty and the Pursuit of Happiness.”xi II) Request for a Fee Waiver and Expedited Processing As a representative of the media and a member of the general public, I do not agree with the opinions expressed by the article published on Business Insider following Michael Smerconish recent interview of Scott Galloway. However, I would highly recommend for you to read the Business Insider article. According to Business Insider, 60% of college and university students are now females. The article notes that this figure is likely to increase in the future. The article also claims that women will be more selective about dating/marrying people who don’t have a college degree.xii As a Black man with a college degree, I believe that women attending colleges/universities at a higher rate than the generation before them is a good thing. As a Black man with a college degree, I have taken issue with the article published by Business Insider following Michael Smerconish interview on CNN because I felt they were both judgmental and reproachful of women dating habits. As a Black man with a college degree, I don’t care who the other chooses to be in a romantic relationship with so long as it’s consensual. xiii As a Black man with a college degree, I am highly suspicious of statistics that have linked happiness in people with children and marriage because I like to think the other is not a sadist or a masochist. As a Black man with a college degree, I think it’s wrong for others to put up barriers and then point fingers at the direction of people not willing to head in the direction of danger by breaking barracks and walls. As a Black man with a college degree, I would like to take this opportunity to reiterate several concerns about the manner in which others are speaking about the consequences of Jeanne Ann Clery rape and murder.xiv On the bases I have mentioned above, I believe this request for records should be expedited and all fees waived. REQUEST FOR RECORDS 10/12/2021 impacted public confidence about the manner in which women and racial minorities are being the topic of conversations; (2) have identified operations and activities of the U.S federal, local and state government alongside non-profit organizations; (3) are meaningfully informative about government operations or activities in order to be likely to contribute to and increase public understanding of those operations. As a Black man with a college degree, I believe that the Business Insider article was unimportant when taking into consideration the systemic racism and sexism faced by women and racial minorities on several campuses of colleges and universities.xv According to the Department of Education (DoED) February 2019 report, the “6-year graduation rate for first- time, full-time undergraduate students who began their pursuit of a bachelor’s degree at a 4- year degree granting institution in fall 2010 was highest for Asians students (74 percent), followed by White Students (64 percent), students of two or more races (60 percent), Hispanic students (54 percent), Pacific Islander students (51 percent), Black students (40 percent), and American Indian/Alaska Native students (39 percent).” In the same February 2019 report, the DoED have noted that in “in 2016, unemployment rates among adults ages 25 to 64 were higher for American Indian/Alaska Native adults (11 percent) than for Black (8 percent), Hispanic (5 percent), White (4 percent), and Asian (4 percent) adults. In addition, a higher percentage of Black than of Hispanic, White and Asian adults were unemployed. (…) In 2016, among those with a bachelor’s or higher degree, Asian full-time, year-round workers ages 25 – 34 had higher median annual earnings ($69,100) than their White peers ($54,700), and median earnings for both racial/ethnic groups were higher than those of their Black ($49,400) and Hispanic (49,300) peers.”xvi The DoED 2019 report has reaffirmed the existence of disparities among people on the basis of race in their graduation rates as well as their earned income following the obtention of a Bachelor Degree. As a Black man with a college degree, I was not shocked by the statistics of the DoED 2019 report even though I found the situation they have described to be deplorable and regrettable. As a Black man with a college degree, I am vexed whenever I audition others discrediting people for condemning systemic racism and sexism. As a Black man with a college degree, I am also vexed whenever I audition others lobbying against the teaching of critical race theory in schools.xvii As a Black man with a college degree, I do not believe that we have reached in Fiscal Year (F.Y) 2021 a post-racial society where people are judged on the basis of merit alone. As a Black man with a college degree, I (personally) believe that discrimination on the basis of race and gender are wrongs that should be remedied without delay. As a Black man with a college degree, I believe that systemic racism is pervasive in American society and that I have (personally) suffered from it. As a Black man with a college degree, I acknowledge the several difficulties and challenges I have faced as an undergraduate student in my efforts to be successful academically and on the job-market. As a Black man with a college degree, I like to think that I have always tried to behave in a manner that was responsible. As a Black man with a college degree, I have a high-esteem for people who hold themselves to account for the decisions they make. As a Black man with a college degree, I like to think that I am with others (irrelevant of their gender, race, sexual orientation, national origin, religious affiliation) fair, impartial, neutral, objective, open- minded and unbiased. As a Black man with a college degree, I believe it’s wrong to have double-standards just like I think it is wrong to display preferential treatment. As a Black man, I am happy and proud of having a Bachelor of Arts Degree.
