Reasons Cited Why There Are Not More Felony Pretrial Releases? • Adult arrests are not declining (nor CJS workforce) • 425,000 sworn officers in 2000 versus 463,000 in 2007 • 2% increase adult arrests since 2000; 1% decline since 2008 • The Jail as the facilitator of guilty pleas • Prior Record of Felony Defendants • 77% have prior felony arrests • 69% have multiple prior felony arrests • 43% have prior felony convictions • No bail/ROR for certain offenses and probation/parole violators • Case processing in-efficiencies and continuance delays • Mental Health/Drug Use Issues • Illegal Immigration-ICE prisoners • Socio Economic Status/Wealth/Money • But most (76%) are returned to community after jail/conviction
LA Jail Pretrial Stress Test • 10,545 - Original pool of pretrial inmates in custody; • 7,044 - Less those not already sentenced to another crime; • 4,978 - Less those with no outstanding warrants; • 2,964 - Less those with “no bails” orders; • 1,753 - Less those with assaultive crimes that prohibit pretrial release; • Less those in maximum or high security (1,367).
