Transfer Process from Statements of Special Educational Needs (SEN) to Education Health and Care (EHC) Plans June/July 2015
Purpose • To discuss the proposed model for the transfer processwith all schools within the Local Authority (LA). • To work jointly with schools to identify and agree the cohort of children and young people who will transfer from a Statement of SEN to an EHC Plan during 2015/2016 academic year. • To discuss and agree the arrangements for the transfers.
The Children and Families Act 2014 (the Act) came into effect from 1 September 2014. Part 3 of the Act focusses on the provision for children and young people aged from birth to 25 years with special educational needs and disabilities. Under the Act all children and young people with Statements of SEN must transfer to the new legal framework by April 2018, following a ‘transfer review’ – that is an Education, Health and Care (EHC) needs assessment. What do we mean by the transfer process? The transfer process
Pre 18 week process Review dates: • Schools share annual review dates with LA. • Transfer review meeting dates will be mutually agreed between schools and LA.
Pre 18week process Attendance: • It is intended that EHC Plan Assessment Coordinators will attend transfer review meetings in order to effectively support the transfer review process.
Pre 18week process Transfer Review Pack: • In August/September 2015 the LA will send schools the transfer review pack which will include: • To be completed: • Transfer review paperwork for schools and professionals (document A and B). • A provision map (document F). • For information only: • Guidance on how to complete transfer review paperwork (document G). • EHC Transfer process flow chart(document C). • An anonymised EHC Plan (document E). • Information on how to construct outcomes (document D). • SEN Support and non statutory Plans
4 weeks before transfer review meeting • School completes transfer review paperwork with pupil before transfer review meeting (see document A). • School sends invitations to attend the transfer review meeting to all professionals currently involved with the child/young person and asks them to submit transfer review paperwork and up to date reports (see document B). • Professionals send completed reports and transfer review paperwork to school. • School collates transfer review paperwork and circulates to the LA and all attending professional. • Transfer review paperwork must be submitted to the LA 2 weeks before transfer reviewdate.
2 weeks before transfer review meeting • LA sends letter to parents/carers and/or young person informing them of the transfer review meeting. • School circulates transfer review paperwork to all professionals involved with child or young person (see document B).
Week 1 of 18 week transfer process Transfer Review Meeting: • School facilitates multi agency transfer review meeting with the parent/carers, young person, LA and relevant professionals. • The transfer review paperwork will form the basis of the meeting and all attendees will mutually agree strengths, needs, outcomes. Person Centred Approach: • This meeting ensures the child/young person’s voice is heard. • This is a key objective to the EHC Plan process.
Weeks 2-3 of 18 week transfer process • School to send completed transfer review paperwork to LA via electronic form onlyto: CYPDS@rbwm.gov.uk. • Password protected. • Subject: Transfer review paperwork [child/young persons initials] [date of meeting DD/MM/YY]
Weeks 4-8 of 18 week transfer process • EHC Plan is drafted by Assessment Coordinator.
Weeks 9-10 of 18 week transfer process • LA sends to the parent/carer or young person (copying in current school): • draft EHC Plan and Section K (all documents used to write the EHC Plan ). • Placement preference form. • Parent/carers and young people have 15 days to submit proposed amendments to the draft EHC Plan. • Parent/carers and/or young people can request meeting with their Assessment Coordinator to discuss their draft EHC Plan.
Weeks 11-12 of 18 week transfer process • LA amends draft EHC Plan following feedback from parent/carer and/or young person. • Amended draft EHC Plan sent to named school on the placement preference form. • LA requests a provision map (see document F) which sets out the support being offered to the child/young person with costings attached.
Weeks 13-14 of the 18 week transfer process • Consultation with school about being named on the EHC Plan. • LA requests a provision map (see document F) within 15 calendar days of receiving the EHC Plan
Weeks 15-18 of 18 week transfer process • Final EHC Plan issuedand sent to: • Parent/carer and/or young person • Current school • Future school
Post 18 week process • EHC Plan will be reviewed annually.
