Nutrition Facts Regulations • 3 Parts • Diet-related Health Claims: provision for 5 new claims • Nutrient Content Claims: updated requirements • Nutrition Labelling: requirements for availability, content and format
Core list of Calories and 13 nutrients always declared. Actual amount of the nutrient in the stated serving of the food is listed for macronutrients. The nutrient information based on a specified amount of food as sold. % Daily Value (%DV) indicates the relative amount of the nutrient in the stated serving. Content: “Nutrition Facts” table
Other Exempt Foods • Beverages with more than 0.5% alcohol • Fresh vegetables or fruits or combinations • Raw, Single-ingredient Meat, Poultry, Fish and by-products (except ground meat and poultry) • road-side stand, farmers’ market, fair, sugar bush • for immediate consumption (without extended shelf life) • packaged at retail + stickered, when ADS <200 cm2 • Products prepared at the retail premises where sold (unless water is the only ingredient added to premix)
Loss of Exemption • nutritional reference, biological role claim, health claim, health logo/symbol/name • “nutrition facts” or valeur nutritive” • intense sweeteners added (aspartame, sucralose etc • added vitamins and mineral nutrients • vitamins & minerals declared as components (except flour)
Always Exempt - one-bite candy, portions sold by restaurant, milks in glass bottles

Nutrient Content Claims New Regulations: • Consolidate 47 permitted claims in Food and Drug Regulations • Specify the product compositional criteria and package labelling requirements • Prohibit all other claims (expressed or implied) that characterize the level of a nutrient
Nutrient Claims - Compositional Criteria Based on: • Regulated reference amounts • standardized quantities reflect the amount of a food consumed at a single eating occasion • Servings of stated size • Serving guidelines • Density criterion of 50 g for “low” claims • for reference amounts of 30 g / mL or less (E.g., reference amount for crackers is 20 g)
Old Nutrient Claims • Low in FatHigh in Fibre • 2 g / 25 g serving - 4 g / 130 g serving
New Nutrient Claims • “low fat”, “only 2 g of fat per serving”, “little fat” • (and other expressions specified in regulation) • Only permitted when there is #3 g fat per; • serving and • reference amount (55 g for muffins) • At 4.4 g fat per 55 g (and 1.7 g fibre) • NO Low Fat claim & NO High Fibre claim
Nutrient Content Claims • New • source of omega-3 & omega-6 fatty acids • free of trans fatty acids/ reduced in trans fatty acids • X% fat-free claims • Revised • Claims for saturated fat & cholesterol: • “light”; now only for foods reduced in energy or fat • Prohibited • Carbohydrate claims
Permitted Diet-related Health Claims • Sodium and hypertension • Calcium and osteoporosis • Saturated and trans fat and heart disease • Fruit and vegetables and some cancers • Fermentable carbohydrate and tooth decay
Diet-Related Health Claim Example: Sodium and hypertension • “A healthy diet containing foods high in potassium and low in sodium may reduce the risk of high blood pressure, a risk factor for stroke and heart disease. (Naming the food) is low in sodium” • Must meet compositional and labelling criteria
Promotion of Any Hot New Substance PIEX • May make a quantitative statement outside of the Nutrition Facts Table. • 0.3 g PieX per 50 g serving • May not make qualitative statement such as; • “High in PieX” or “Bread is a source of PieX”
Retailer Examples • Deli Counter • Meat Department • Bakery Department • Fruit and Vegetable Department
Non-Packaged Food - Exempt • Non-packaged foods are exempt from a Nutrition Facts table (NFT). • when a claim is made in advertising or on a sign, the nutrient must be declared per serving of stated size • Examples; • non-prepackaged clerk served; deli meat, salads, steaks, chicken, ground meat, bread, desserts • bulk consumer packaged; olives, sun-dried tomatoes, buns, bagels, soup mix, candy, fruit, vegetables
Packaged Foods - Exempt • Exempt from NFT no matter who does the packaging • fresh or frozen single ingredient meat, poultry, and byproducts • includes, chicken, chicken legs, steak, roasts etc. • does not include ground meat / poultry • fresh fruit and vegetables • includes oranges with colour, and fruit and vegetables coated with parafin wax or petrolatum • does not include dried vegetables
Retail Packaged Foods - Exempt • Foods manufactured off premises and packaged at the retail store are exempt from a NFT when the package is labelled with a sticker and the ADS < 200 cm2 • includes small packages of candy, soup mix, spicy meats, muffins, cake squares and retail cut, wrapped, stickered squares of cheese, • does not include meats with added phosphates and/or water
Retail Packaged Foods - Not Exempt • Foods manufactured off premises and packaged at the retail store are not exempt from a NFT when the ADS $ 200 cm2(even if stickered) • includes larger packages of candy, soup mix, muffins, cake squares, bread, baked goods, sauces, plus retail cut, wrapped, stickered blocks of cheese, ground meat, spiced/phosphated meats • Note the retailer may choose any of the following formats without regard to package ADS • Standard 1.1-1.3, Narrow Standard 2.1-2.3, Bilingual Standard 3.1-3.3 NFT formats (Also see Simplified Formats)
Retail Prepared Foods • Are not required to carry a NFT when they are sold only in the establishment where the product is prepared and processed from its ingredients • includes; pizza, salads, sauces, sausages, bread, baked goods • does not include; products made from a pre-mix when water is the only added ingredient, or frozen bread baked on site.
Loss of Exemption • The exemptions are conditional and lost when; • nutritional reference, biological role claim, health claim, health logo/symbol/name • “nutrition facts” or valeur nutritive” • intense sweeteners added (aspartame, sucralose etc.) • added vitamins and mineral nutrients • vitamins & minerals declared as components (except flour)
Bilingual Labelling • *Bilingual Labelling is not required for; • Products packaged and sold at the retail store. • Packaged products (including those manufacturered by a retailer) when sold only in the local government unit where the product was manufactured and in any immediately adjacent local government unit. (e.g., city, municipality etc.) • *On the assumption the second official language is the mother tongue of the less than 10% of the population.
