Roe v. Wade. Griswold v. Connecticut  381 U.S. 479 (1965 ). Law at the time = Any use of contraception (something that prevents conception) would result in a fine or jail time.  PREVENTING PREGNANCY WAS ILLEGAL. Court said that people had a right to privacy .

  2. Griswold v. Connecticut  381 U.S. 479 (1965) • Law at the time = Any use of contraception (something that prevents conception) would result in a fine or jail time.  PREVENTING PREGNANCY WAS ILLEGAL. • Court said that people had a right to privacy. • If this law was not struck down, would this law be enforced by police officers searching someone's bedroom to find contraceptives?

  3. Roe v. Wade.  410 U.S. 113 (1973) • Before Roe v. Wade, abortion was completely illegal in many of the 50 states in the U.S.

  4. Roe v. Wade.  410 U.S. 113 (1973) • Court’s ruling: • Abortions that happened in the first 3 months could not be limited by states. (They were legal) • Based on a right to privacy from the 14th Amendment and reservation of this right to women based on 9th Amendment.

  5. What has happened since then?

  6. Planned Parenthood v. Casey.  505 U.S. 833 (1992) • -Said Roe v. Wade was good law, but changed from trimester split to statement that prior to viability (the child being able to live on their own, abortion could not be regulated.

  7. Stenberg v. Carhart.  530 U.S. 914 (2000) • A Nebraska Law limiting abortion illegal because it did not provide for the health of the mother.

  8. Gonzales v. Carhart.  550 U.S. 124 (2007) • Upheld Partial Birth Abortion ban.

  9. Unborn Victims of Violence Act.  (2004) • If a child "in utero" is injured or killed during the commission of certain federal crimes of violence, then the attacker may be charged for the death of a second person (the unborn fetus/baby).

  10. Wisconsin Legislature = Attempt in 2013 to change State Constitution: • From: • All people are born equally free and independent, and have certain inherent rights; among these are life, liberty and the pursuit of happiness..." • To: • All people are equally free and independent, and have certain inherent rights; among these are life, liberty and the pursuit of happiness...  As applied to the right to life, the terms 'people' and 'person' shall apply to every human being at any stage of development.

  11. Two issues: • “When does life begin? Just as important: when does a fetus/baby have rights and protections?” • How intrusive are we willing for the government to be in our lives? Do we want the government invading our homes and doctor’s offices?
