  2. Dartmouth • In 1769 King George III of England granted a charter to Dartmouth College. This document spelled out the purpose of the school, set up the structure to govern it, and gave land to the college.

  3. The Issue • New Hampshire wanted to turn Dartmouth college into a public state school.

  4. The case • This case ruled that New Hampshire could not seize Dartmouth college to turn the institution into a state school. The school’s private charter with the British Crown involved private property and was a contract. Chief Justice John Marshall invoked the contract’s clause of Article 1: Section 10: “The Legislature of a state shall pass no act impairing the obligations of contracts.”

  5. The Moral • The constitution says that the state’s government shall not interfere between legal contracts.
