Criminal Justice Systems Formal versus Informal Systems
In Canada • We use a formal system – multiple components, highly structured • 3 components: law enforcement, courts, and correctional agencies/institutions
Law Enforcement • Considered the “front line” of the system; run by different levels of government • Goals: protect society, prevent crime; apprehend and arrest criminals
Courts • We use an adversarial system: the defense and prosecution “compete” to “win” the case • Lawyers can be appointed if a defendant can’t afford one – ensures everyone receives a fair trial
KP Info • Maximum security facility • Opened 1835 • Inmates in facility to date: 494 • Used to include a women’s facility as well • Kids used to be incarcerated as well (up to age 8) • Has had 3 major riots
“He who opens a school door, closes a prison.” ~ Victor Hugo
Informal Systems – Aboriginal • These systems seek to heal the person who committed the offense, and reintegrate them back into society; they also strive to correct the conditions that led to the offense
Informal Systems – Kpelle of Africa • Has a formal & informal branch (moot) • Handles: assault, possession of illegal arms, theft (between unrelated individuals) • Kpelle moot – informal airing of a dispute before an assembled group – mediated by a person (kinsman) chosen by the complainant
