  2. Getting arrested in New York is a devastating experience for most of us. Even if you never expect to be in trouble with the police, you should have some basic knowledge about your rights and things you can do to help yourself – and your attorney – when you are facing criminal charges.

  3. #1 You don’t convince the officer The New York law enforcement officer is doing his duty, he is not an adjudicator of you guilt or innocence Don’t ever try to convince the officer of your innocence Your lawyer will handle your defense and prove your innocence

  4. #2 Don’t try to run away A New York police officer could ask people to stop or pull over if he suspects something unusual If a police officer is following you then don’t try to get away That may lead to more charges on you

  5. #3 Keep your mouth shut You have the right to remain silent Don’t give any statement Anything you say can be used in court against you

  6. #5. Never lie to the police Never lie to the police However, depending on the situation, it might be best for you to not talk to the police about what happened Always consult your lawyer before talking to police or giving a statement or signing any paper

  7. #4. Call your attorney You have right to call your attorney Hire a New York criminal defense attorney early in your case, before the case goes to court If you cannot afford an attorney, one will be provided to you by the court Police cannot appointan attorney for you

  8. #6. Say nothing to anyone but your lawyer You should avoid talking to anyoneother than your lawyer about the facts of your case. Anyone elseyou speak to about your case may also be used as a witness against you Always remember whenever you make any calls from jail, calls are recorded

  9. #7. In court, ask for a lawyer As stated earlier, hire a criminal defense lawyer early in your case When you are taken before a judge in either General Sessions Court or General District Court, you can ask the judge to appoint a lawyer for you if you cannot afford it

  10. #8.  In court, ask for a preliminary hearing When you are arrested for more serious offenses, you have a right to a preliminary hearing The purpose of a preliminary hearing is to determine whether there is probable cause to charge you with a crime Be present with your defense attorney in the preliminary hearing

  11. #9. Don’t allow police officer to search If they are asking for your permission, it means they probably don’t have the right to search and need your permission for that. Don’t allow them to carry a search. If you give permission, you loose the option of challenging the search later
