Project Agreement THIS AGREEMENT (this "Agreement") is made the 23rd day of November 2007
Project Agreement Objectives (i) building and operating a new tunnelto conform to current safety requirements and refurbishing and operating the existing tunnels to best practice consistent with their construction and listed status; (ii) facilitating the amicable transfer of Transferring Employees to the Concessionaire; (iii) minimising the actual toll level charged to users – including maintaining the current zero VAT rating; (iv) promoting public transport, cycle and pedestrian use of the Existing Tunnels and New Tunnel; (v) procuring the New Tunnel without the need to seek Government PFI Credits or other public sector financial support; (vi) minimising the environmental and social impact of the New Tunnel on local residents and businesses, both during construction and operation; (vii) protecting and promoting the ecology of the Tyne and its tributaries as an important element of the region's environment; (viii) minimising disruption to the operation of the Existing Tunnels during construction; (ix) minimise disruption to the movement of river traffic and the operation of riverside businesses; (x) incentivising the Concessionaire to complete the construction processes as soon as practicable; (xi) allowing flexibility in the Contract Period to facilitate the above objectives; (xii) supporting the Port of Tyne Authority as the road, rail and marine freight hub for the North East region; and (xiii) pro-actively communicating and liaising with all affected authorities, agencies, land owners and communities to foster good relations and understanding of the project and the TWPTA's objective.
