ADVOCACY FOR THE IMPLEMENTATION OF HIV/AIDS PREVENTION AND CONTRAL ACT NO. 14 OF 2006
Rights to be addressed • Right to life • Right to work • Right to privacy owner and reputation. • Right to health care services. • Right to information and expression. • Right to education. • Right to equal protection of the law.
ISSUES • The Act lacks a commencement date despite it being 1 & ¼ years old. • The relevant minister is silent on section 45 of the Act
Section 24 of the Act, infringes the right to confidentiality of the infected and leaves burden of prevention to the people the Act is purported to be protecting The HIV/AIDS Tribunal is lacking as per the section 25 of the Act. ISSUES Cont.
ISSUES Cont. • Lack of representation of MIPA in the proposed Tribunal under sect 25 of the Act. • Lack of CSOs representation in the tribunal under sec. 25 of the Act. • Lack of clear rules that will govern the Act as per sec. 30 of the same. • Lack of clear commitment from the government on provision of ARTs and OI drugs,
STRATEGIES • To educate the Kenyan population and build their capacity to understand the contents of the Act. • Popularize the act through both print and electronic media. • lobby stakeholders to support the issues raised. • Engage the government and its policy makers to adopt and implement the act.
Strategies continue • Lobby the Government to factor funds for the operationalisation of the act • Lobby for the setting of clear rules, roles and responsibilities between the minister of special programs and minister for health and prescribe various guidelines. • Lobby for mainstreaming MIPA in section 25 of the act. • Harmonize section 24 with section 20,21, 22 and 23 of the act to promote confidentiality.
Strategies continue • Lobby for the amendment of section 25 to include CSOs and MIPA representation. • Lobby for clear policy that will guarantee provision of ARTs and OIs drugs.
