FERPA The Family Educational Rights and Privacy Act (FERPA) of 1974 is sometimes referred to as the “Buckley Amendment.” Named for Senator James L. Buckley (1923 - ) who authored the act.
Purpose • To protect the privacy of students. • To insure the rights of students (and parents of dependent students) access to student records. • Clarifies definition of “student records.” • Identifies “directory information.” • Gives control over disclosure of information from the records.
Who is a “student?” A person who… … has officially matriculated. …is in attendance at the institution. A student is NOT a person who has been denied admission.
What are“student records?” All records that directly relate to a student and are maintained by the institution. Records can be in several different media forms including: Handwritten or printed pages Film Electronic Etc. Records include: Registration forms Student schedules Grades & Transcripts Assignments & Exams Class Rosters Any paper with a Student ID Records do NOT include personal notes, official records kept by other agencies (i.e. medical/health records, law enforcement records, employment records, alumni donations)
What is“directoryinformation?” A few examples are: Name Address Phone E-dress Birthday Photo Height Weight Dates of attendance Major and Degree
Students and Former Students have the right to… …know where educational records are kept. …inspect their educational records. …have records amended if necessary. …expect their educational records to be kept confidential. …suppress the disclosure of directory information (one or more items). …file a complaint with the U.S. Department of Education if they feel their rights have been violated!
Law Loopholes! • Parents of dependents -important to know who is a dependent on a postsecondary institutional campus • Student Lenders • Certain State & Federal Agencies • Court subpoenas -usually must be complied with but MUST notify student of the subpoena ASAP • Military Recruiters • People with “Legitimate Educational Interest” -admissions personnel • Appropriate individuals in an emergency in order to protect the health and safety of the student or other persons
