Ordinance Violation Discovered by Authorized Enforcement Agency (AEA) Post-Construction Storm Water Management Ordinance AEA shall notify responsible party by certified mail of violation Problem continues Problem Corrected If violation may cause damage to properties, public facilities, or waters of the state, AEA can take emergency action to prevent such damage. Costs incurred by the Town shall be billed to the responsible party. AEA can authorize stop work order or request the Town Attorney to obtain a cease and desist order. AEA can revoke a permit for non compliance. Note: Stop-work order or permit revocation can be retracted Problem Continues Problem Corrected Authorized Enforcement Agency: Employees or designees of the Town Board will be the Town Staff, including the building inspector, fire inspector and Town Engineer. Staff will monitor when at construction sites, doing inspections of water/sewer laterals, inside business facilities, etc. Building Inspector and Fire Inspector will be asked to watch for any illicit discharge or illegal connections when on sites. Board of Appeals: Board of Appeals May Authorize provision to the ordinance with proof of unnecessary hardship and using other rules, procedures, duties and powers authorized by statue of hearing deciding appeals and authorizing variances.
