Public Private Partnerships in CPR • A more prominent role for public-private partnerships in the Common Provisions Regulation: • Recital 59: "this Regulation should take account of certain characteristics specific to PPPs" • Article 2: definitions 24-26 • Articles 62-64: Delegated Acts are expansions of the provisions of these articles
Delegated Act: Article 63(4): Additional conditions on the replacement of the private partner in a PPP • Article 1: conditions for replacement • Body or bodies replacing the private partners must fulfill the minimum conditions originally used when selecting the body being replaced • Replacement body agrees to assume the rights and obligations of a beneficiary in relation to a grant
Delegated Act: Article 63(4): Additional conditions on the replacement of the private partner in a PPP • Article 2: notification of managing authority: the body replacing a private partner must inform the managing authority in writing of the replacement • Article 3: confirmation of notification of replacement by managing authority and notification of change to Commission
Delegated Act: Article 64(4): Minimum requirements in PPP agreements featuring an escrow account • Article 1: PPP agreement must contain minimum conditions • Article 2: requirements in PPP agreement concerning escrow account, including selection of financial institution, conditions to make payments, information to be provided to managing authority • Article 3: provision for closure of an escrow account • Article 4: reporting and audit trail
