Objective of the Commission • The objective of the Commission is to promote competition in the economy in order to: • promote the efficiency, adaptability and development of the economy; • provide consumers with competitive prices and product choices; • promote employment and advance the social and economic welfare of South Africans; • expand opportunities for South African participation in world markets and recognize the role of foreign competition in South Africa; • ensure that small and medium-sized enterprises have an equitable opportunity to participate in the economy; and • promote a greater spread of ownership, in particular to increase the ownership stakes of historically disadvantaged persons.

Situational analysis • Legislative mandate: Promulgation of Competition Amendment Act in 2012 / 2013 • President Jacob Zuma has determined that section 6 of section of the Competition Amendment Act 1 of 2009 (2009 Amendment), will come into effect on 01 April 2013, this provides the Competition Commission (“Commission”) with formal powers to conduct market inquiries. • Stakeholder engagement • Opportunity for Commission to make input into industrial and economic policy processes; • Facilitating participation of wider stakeholders • The role of economic law and policy as a catalyst in bringing about economic transformation Increased focus on outcomes that impacts on the economy. • Adverse Court Decisions: impact on ability to initiate and investigate complaints. • Constitutional Court decisions and implications
