Prison systems are intended to be Correctional Facilities Not intended for punishments There is no way to rehabilitate a dead person Corrections, not Punishment
The wording of the Eight Amendment: “Excessive bail should not be required, nor excessive fines imposed, nor cruel and unusual punishment inflicted.” • Vague wording for “cruel and unusual” • Does it depend on the crime? • Are some things always cruel and unusual? • Which interpretation protects citizens the best? “Cruel and Unusual”
Death row inmates cost more • Single cells • Amenities • Legal fees (paid by the state) • Putting prisoners in general population for life costs significantly less • Death Row inmates are not significant threats to other prisoners Cost of Murder
