Setting the Stage: • Many do not know that physical education is an academic area under the laws regarding special education. • The program may be a general physical education program or a segregated one. • General physical education is the current term for describing our programs as it lines up with the current laws.
To place a student outside the general program, the educational team must document the need for special services. • This process follows a set procedure for the district involved and is basically similar in across the U.S.
The General set up for determining need: • Child Find programs-early detection system • Usually done through screening of some type, especially for preschool ages. • For school age students, a team will commonly exist to assess students who are not in special ed., but may need assistance.
This team looks at what has been done in the area of opportunities, instruction, curriculum, and delivery or service. This is documented by the respective teacher. • If reasonable modifications have been made and the student is still not succeeding, a referral for special education may be made.
Referral for special service can be made by the parent, the teacher or even others. • Nothing can be done without the permission of the parent. • Specific evaluations are made that will give indications as to whether the student will meet eligibility under state criteria.
If eligibility exists, an IEP is developed with goals and objectives and identifies the placement. • The physical education teacher is responsible for writing the goals in their area and seeing they are meet. • Placement is to be in the least restrictive environment. • Before a student could be removed from a general program it must be shown they cannot succeed there.

Overall considerations in special physical education • 1. Number of class meeting and instructional minutes. • 2. Number of years of years of required instruction. • 3. Qualifications of the teacher. • 4. Environment-least restrictive.
Additional terms to remember: • Laws-mandated by US congress or a state legislature. • Regulations-mandated requirements of the US Department of Education. • Rule- requirements of a state board of education. • Guidelines-suggestions that direct or set a standard practice.
What does Physical Education mean under IDEA 2004? • Go to page 114 • Yes, those are all the areas that apply to general physical education as well. • Yes, they are to be included in special physical education as well! • Physical education is a direct service under the law-it is an academic area-not a support service!
Common support service are OT-Occupational Therapy and PT-Physical Therapy. • Go to your text page 120 for the definitions-know them.
