  2. SURVEY • Prior to any renovation or demolition you are required to survey for asbestos containing materials (acm)

  3. Who enforces this rule? • Federal EPA • Nebraska State Department of Health • OSHA

  4. RENOVATIONS • Complete survey of facility –Check existing for compliance • Remove any asbestos materials impacted • 10 day wait permit (2 weeks) • 7 day wait for floor solvents

  5. DEMOLITION • Complete survey of facility – Check existing for compliance • Remove all asbestos materials • 10 day wait for permit

  6. Regulations -NEW RRP – Renovation, Repair and Painting Final Rule (EPA) • Covers pre-1978 houses and child occupied facilities • Firms must be registered with EPA • Specific Training – Lead Renovator • Specific work practices –additional costs to projects • April 22, 2010

  7. Child-Occupied Facility A child-occupied facility is a pre- 1978 building that meets all three of the following criteria: • Visited regularly by the same child, under 6 years of age. • The visits are on at least two different days within any week (Sunday through Saturday period), provided that each day’s visit lasts at least 3 hours • Combined weekly visits last at least 6 hours, and the combined annual visits last 60 hours.

  8. Child-Occupied Facilities • Child occupied facilities may be located in public or commercial buildings or in target housing. These facilities include schools, child care facilities, and daycare centers.

  9. The RRP Rule: Enforcement • EPA may suspend, revoke, or modify a firm’s certification if the Certified Firm or Certified Renovator is found to be in non-compliance. • Those firms found to be non-compliant may be liable for civil penalties of up to $32,500 for each violation. • Those firms who knowingly or willfully violate this regulation may be subject to fines of up to an additional $32,500 per violation, or imprisonment, or both.
