  2. ESA Laws in California are a set of rules and regulations passed by the government of California to protect ESA Owners and Emotional Support Animals(ESAs) from discrimination.

  3. ESA Housing Law This law allows an ESA Owner to live with ESA in a rental property without facing any landlord discrimination. A person doesn't need to pay extra charges to live with ESA in a rental property.

  4. Important Things to Keep in Mind • A landlord can deny the request to live with ESA if ESA is not well-behaved. • A person must have an ESA Letter to get the benefits of ESA Housing Law

  5. New California ESA Law(AB 468) This law is passed to stop those who willingly mispresent their ESA as a service animal. These people do so to enjoy the privileges of service animals. This law is divided into three sections.

  6. First Section Guidelines • This section contains guidelines for a business that supplies dogs as emotional support dogs. They need to provide a note stating: • Since the dog is not trained, it is not suitable for being a guide, signal, or service dog. • This dog cannot receive benefits meant for guide, signal or service dogs • Falsely representing this dog as a guide, signal or service dog is illegal

  7. Second Section Guidelines This section contains guidelines for ESA Letter providers. They need to provide a certification that certifies the dog as an emotional support animal, not a service dog. Individuals who violate the law may be sentenced to a maximum of six months in the county jail.

  8. Third Section Guidelines • This section contains guidelines for Licensed Mental Healthcare Experts who certify a pet as emotional support animal. Here are a few guidelines: • The LHMP must establish a client-provider relationship with the patient for at least 30 days before issuing the ESA document. • The LHMP must conduct an honest and thorough evaluation.
