IDEA 2004A focus on early identification of non-learning and intervention • An LEA may not use more than 15 percent . . To develop and implement coordinated, early intervening services. [34 CFR § 300.226 (a)] • A State . . (1) Must not require the use of a severe discrepancy . . .(2) Must permit the use of a process based on the child’s response to scientific, research-based intervention. [34 CFR § 300.307 9a) (2) (2)]
State Implementation of RTI for LD86% Return Rate • Statewide training efforts are underway in 90% of the states primarily emphasizing an overview of RTI, progress monitoring and the use of data-driven decision-making. • Over one-third of the states indicated that they plan to use RTI, in part, as a replacement or supplement to the learning disability discrepancy model. • Most states indicated that they are or plan to use a combined problem solving- standard treatment protocol model for making multi-tiered RTI decisions.
State Implementation of PBIS • 49 states plus Washington DC have some relationship with Center for PBIS (http://www.pbis.org/map.htm) • Many improvement activities related to making sure that PBS was well implemented and well understood (Part B SPP/APR Indicator Analyses 8/01/07) • Providing TA/training/professional development listed by 47 states including, but not limited to, PBIS and RTI to reduce suspensions and expulsions ( Part B SPP/APR 2008 Indicator Analyses)
