Kansas One Call LawandWater and Sewer Utilities • (e) "Facility" means any underground system used for gas, electricity, communication, petroleum products or hazardous liquids; facility shall not include, any production petroleum lead lines, salt water disposal lines or injection lines, which are not located on platted land or inside the corporate limits of any city.
Kansas Law is silent regarding Water and Sewer Utilities and Damage Prevention
What’s that mean according to the One Call Law? • Excavator Not Required to make 2nd Call or Use “Reasonable Care”. • Operator Not Required to Mark or know where the buried lines are.
Kansas Comparative Fault Law • “Ordinary Care” provision. • Liability determined by amount excavator or operator is at fault. • All Easements Non-Exclusive.

Managing Locate Request (With membership in Kansas One Call)
Operator Defines Area for locates • Certificated Area • Piping “Polygons”
Certificated Area • Notified for every request where the “dig box” touches the certificated area. • “dig box” is the area called in by excavator telling where locates are necessary.
Polygon Area Notification • Can be as small as 50 feet wide.
BUT….How do you manage Locate Requests? • Even non KOC members receive them. • Locates aren’t even in same township as my facilities. • Description says “mark the entire property.” • Repeat requests every 15 days.

Strategies for Minimizing Costs • GOOD ACCURATE MAPS • Bad locate is worse than no locate. • Understand the description, what digging is for, and ask excavator questions. • Look at a map before calling excavator. • Sketch out what he wants to dig • Does it make Sense? • Can he reduce the size of the dig box?

Dissecting the Locate Request • Questions: • 200 by 300, (1.4 acres) is reasonable? • 3 month duration would require multiple updates. • Can he protect your marks for a long period of time? • When does he anticipate working near your facility? • How much should he pay for updates? • Does he know who to call/ what to do if he hits your facility?
Dissecting the Locate Request • “Unless otherwise agreed between the parties”. • Whatever you negotiate with the excavator, • GET IT IN WRITING!!! • Both parties should sign.
