  2. The fitness club showed her the paper work and for the financing instead of paying the full payment to use the gym up front would cost more. • She wanted out of the membership but she signed a contact, so there is a fee for leaving the contract early.

  3. Health Club Contract- A contract provided by the gym to let members work out for a fee. • Class Action- A lawsuit filed or defended by an individual or small group acting on behalf of a large group.

  4. Citation • Ruiz v. Bally Total Fitness Holding Corp., 496 F.3d 1 (1st Cir., 2007)

  5. Decision • Affirmed. The HCSCA states that “No contract for health club services shall require payments or financing by the buyer over a period that extends more than one month beyond the expiration of the contract.” Ruiz claims the financing of the $1,565 over 36 months violates the contract. • The terms of the contract were clear and she won.
