What is REACH?Registration, Evaluation, Authorization and Restriction of Chemicals • Entered into Force: June 1, 2007 • EuropeanLegislation to: • Improve the protection of human health and environment from the risks posed by chemicals • Enhance competitiveness of the EU chemicals industry • Promote alternative methods for the assessment of hazards of substances • Very Complex • Replaces approximately 40 pieces of existing legislation • Broad in Scope • Affects most industries • Expected to regulate 30,000 chemicals • Is Legal Entity based • Covers all products coming in the front door and out the back door of EU facilities • Far-Reaching into Supply Chain • Affects all actors in a given supply chain • Requires EU companies to obtain information from their supply chains that essentially makes everyone be pseudo-REACH compliant • Shifts to Producer Responsibility • Shifts responsibility from regulators to industry to prove the chemicals that industry produces, uses, and places on the market are safe for humans and the environment • Law Specifically States “No data, no market” • If you don’t comply you can’t sell Emerson Confidential

ECHA: European Chemicals Agency SVHC: Substances of Very High Concern REACHKey Dates Affecting Emerson REACH Enters into Force 01 June 2007 Today Substance Pre-Registration Begins 01 Jun 2008 Critical Activity to Supply Continuity in EU 1 Publish Date is Not Defined - Expected Q4 2008-Early 2009 Substance Pre-Registration Ends 01 Dec 2008 ECHA Publishes “Candidate List” of SVHCs for Annex XIV ECHA Publishes List Pre-Registered Substances 01 Jan 2009 3 months Industry Input to Candidate List 2 months ECHA Reviews Industry Input “Restricted List” in Annex XVII Enters into Force ECHA Publishes “Priority List” of SVHCs for Annex XIV 01 Jun 2009 1 According to the law, as soon as the “Candidate List” is published on the ECHA website, the duty to communicate SVHC concentrations > 0.1% w/w begins.

Corporate Procurement’s Role • Centralizing Communication to Suppliers • Published list of suppliers (Corporate Procurement Website > Vital Links > REACH Documentation> Corporate Supplier Contact List ) Also coming on the REACH SharePoint Site • Suppliers who sell to 5+ divisions and marquee & approved preferred suppliers • Process centralized in GMDC • GMDC Will Contact Divisions Regarding Only Suppliers Noted Above • To obtain supplier contact information • To obtain REACH-relevant parts list • Process begins 6/2 • GMDC Sends Letter to Supplier & Requests Material Disclosure • Supplier Letters forthcoming on the REACH SharePoint Site (no later than 6/2) • GMDC Tracks Responses in Widely Accessible Database • Database link forthcoming • GMDC Escalates Insufficient Responses for Resolution • Preferred Supplier  contact corporate commodity team • Non-preferred suppliers  contact division with major buy initially What to Expect Emerson Confidential

Division’s Interaction with Corporate Procurement • Divisions Communicate to the Remaining Supply Base • GMDC contacting the following suppliers on behalf of Corporate Procurement (Corporate Procurement Website > Vital Links > REACH Documentation> Corporate Supplier Contact List ) • Divisions Maintain Registration & SVHC Requirements for New Parts/Products • Provide GMDC List of REACH-Relevant Parts & Supplier Contacts Upon Request • Process begins with pilot week of 6/2/08 • Monitor the Corporate Gathered Data; Combine as Necessary with Division Supplier Data • Database link forthcoming • Participate in Contacting Suppliers when Escalation is Required (upon request) • Complete Communication for Pre-Registration & SVHC Requirements for Balance of Supply Base • Pre-Registration deadline is December 1, 2008 • Obligation to communicate SVHCs in articles to customers is late 2008 (no official deadline documented by European Commission thus far) Required Actions
