What is LOD/NOE? • The Line Of Duty (LOD) determination is the first step required to obtain benefits under the reserve incapacitation system. • The Notice of Eligibility(NOE) process allows a member to receive medical care, at no charge, for injuries incurred in the line of duty, and possible compensation for any time lost from civilian employment.
The Process • If a member incurs an injury during ADT/IDT, orders <30 days, they are required to report it to their Supervisor and the Medical Department. (If on orders >30 days, they are covered by Tricare Prime and maybe retained on AD until care is complete) • Medical Staff will make an appointment at Naval Station Mayport for an exam to document the injury. This documentation needs to be thorough. It will go with your request for the NOE. If you live over 50 miles, the Command may decide to issue orders and provide local berthing so travel expenses are not the members responsibility.
Line of Duty (LOD) Investigation • The member should begin working on the LOD form CG 3822 and/or CG 4614 with their Chain of Command to report the incident. • CG 4614-Report of Illness of a Reservist • CG 3822-Injury Report for Not Misconduct and In Line of Duty Determination • The Accident Report
Line of Duty(LOD) • The Command will decide if this injury was incurred in the line of duty or if a formal investigation will need to be completed. • If they decide to include a formal investigation, the Command will appoint an Investigating officer. • Please reference: • The Administrative Investigations Manual • COMDINST 5830.1
Notice of Eligibility(NOE) • Next, the NOE needs to be completed. The following needs to be included in the NOE request: • Signed CG 3822/CG 4614 • Command Endorsement or, if necessary, the formal investigation report • All medical documentation regarding injury • Physicians Report-located on the PSC-RPM3 website • Copy of Orders

NOE Approval • The Command will receive a memo back including a travel TONO and the accounting info for members to file claims associated with travelling for health care. • The Command must send PSC-RPM-3 a copy of the NOE endorsement on Administrative Remarks (CG-3307) RIB-1 with the members signature within 5 business days. • It is the Member/Commands responsibility to provide updates to PSC-RPM-3, to include the medical documentation, every 30 days, or in advance of an NOE extension request. Once cleared as fit for full duty (AFFD) by a MILITARY PHYSICIAN, provide documentation to close NOE. • All requests for extension must be submitted via CGMS using the template on PCS-RPM-3 web page. http://www.uscg.mil/rpm/rpm3/medical/noe.asp
NOE Greater than 6 months • If the member is not approved for Temporary limited duty (TLD) by HSWL-SC and an NOE extension is needed over 6 months then a Medical Evaluation Board must be started. • Follow the Physical Disabilities Evaluation System (COMDINST M1850.2)
If NOE is not approved • You have 30 days to submit an appeal, otherwise you will be responsible for the cost of your care with your Primary Health care provider or the VA if you are eligible. If your NOE is denied, the Coast Guard assumes no financial responsibility for your care.
Incapacitation Pay • A reservist who incurs or aggravates an injury, illness, or disease in the line of duty is entitled to pay and allowances, and travel and transportation incident to medical and/or dental care. • Individual claims for incapacitation pay shall be submitted to the District (Dxr) via the chain of command as soon as possible following documentation of lost civilian wages.
Incapacitation Pay • the member must submit a statement to the servicing DXR via the COC declaring any earned income, enclose a copy of the NOE, medical officer’s certification, and a letter from his or her civilian employer containing: • The employer’s mailing address, Supervisor’s name and phone number, Certification and reason that the member has not returned to work, and Documentation of any normal wages, salaries, professional fees, tips, vacation pays, sick leave, disability insurance, or other compensation (if any) that the member has received. In the case of a student in receipt of financial aid, certification that the member has not returned to school must be provided, along with documentation of financial aid received.
Duties after Injury • A member may participate in IDT drills in a limited duty status with command approval. • A member may not participate in ADT, ADOT, ADOS-AC, ADOS-RC, Title 10, or Title 14 until cleared Available for Full Duty (AFFD).
Dental NOE • Emergent dental care includes control of bleeding, pain or infection incurred in the line of duty. • All the same forms for NOE apply for submission to PSC-RPM. • All NOEs require pre‐approval of dental care services by the Dental Service Point of Contact (DSPOC) prior to treatment. • They will forward NOE info to United Concordia for review. • The dentist office you see, will submit the Active Duty Dental Program (ADDP) Authorization form to United Concordia for review. • The member needs to be aware that the approval process can be 6 weeks to 4 months.
