Who must be trained according to the worker protection standards? • Anyone who handles or applies pesticides • Anyone whose work brings them into contact with pesticide-treated plants including hand-labor workers

The Illinois Pesticide Act (Illinois Department of Agriculture)
Unlawful To: • Use another’s license to purchase a pesticide • Use or purchase any pesticide without the required license category • Sell a Restricted Use pesticide to anyone that is not a licensed applicator
Unlawful To: • Apply a pesticide in a faulty, careless, or negligent manner • Use or recommend a pesticide inconsistent with its label • Use or supervise the use of any pesticide without the required license
Unlawful To: • Endanger man, the public health, the environment, food, feed, or stored product • Pollute water supplies by improperly using, disposing, handling, or displaying pesticides
Administrative penalties • Suspend, revoke, or modify any license, certification, or registration • Additional monetary penalties possible
Penalties - Fines • No License - 1st time $500 - 2nd time $1000 • Violation of Stop-Use Order - $2500 • Sell RUP to non-certified applicator - $1000

Types of License - Pesticide Dealer • Only sells RUP’s • Records kept for 2 years • Test and $100.00 fee • Commercial Applicator exempt from test and fee - but must register

Restricted Use Pesticide Application Records to be kept by Commercial Applicators and Operators • Name of the chemical • USEPA registration number of chemical • Amount of chemical used per area treated • Date chemical was applied • Keep records for two years
Certification RequirementsAll Operators 1. Be employed, sponsored and supervised by licensed Applicator 2. Pass General Standards or Aerial General Standards exam 3. Complete and mail application to Springfield within 90 days 4. Commercial $25.00 annual fee
All licenses (except Private) expire on December 31 each year.
The director shall not issue a license to a person who has not made an application for renewal within 60 days following expiration without an additional fee. Must apply by March 1 each year by LAW!
Late Fee • Late fee ($20.00) between March 1 and April 15th (Grace Period) • all licenses
Testing • Test 3 times in 6 months • Take the same test 2 times in 1 day • 70% pass all tests • Recommend 68% or less do not retake same day
